Please review the attached Terms and Conditions pertaining to the submission of this bid. The Affidavit for Filing with Competitive Bid and the Business Relationship Affidavit must have original signatures, be notarized and returned with your bid submission. This bid is submitted as a legal offer and any bid when accepted by the county constitutes a firm contract. Purchases by Rogers County. Oklahoma are not subject to state or federal taxes. Any additional products/pricing other than what is requested for bid will not be reviewed. The bidder shall attach the manufacturer's name of the equipment or material to be furnished, type, model numbers, manufacturer's descriptive bulletins and specifications. All guarantees and warranties should be clearly stated. This data shall be in sufficient detail to describe accurately the equipment or material to be furnished. Manufacturer's specifications, in respect to the successful bidder, shall be considered as part of the contract with Rogers County. The Board of County Commissioners will analyze all qualifying bid submissions. The lowest and/or best bid will be determined based on the following considerations: a. Price per unit of measure. b. Distance and delivery time to the desired destination. c. Product source (manufacturer, retailer jobber) d. Product availability. e. Product quality. f. Vendor's reliability. g. Specific conditions identified by the vendors triggering a base increase. h. Any additional consideration as may be deemed appropriate by the Board of County Commissioners. Bid may show number of days required for delivery under normal conditions. Contractor must keep the County advised of the status of the order. For any exception to the delivery date as specified on this order, vendor shall give prior notification. Oklahoma laws require each bidder submitting a bid to a county for goods or services to furnish notarized affidavit for filing with Competitive Bid and a Business Relationships Affidavit (Affidavits are included in bid packet). The Rogers County Board of Commissioners reserve the right to accept or reject any or all bids and to make the bid award in the best interest of Rogers County. Bidder agrees to defend and to save Rogers County from and against all demands, claims cost, expense, damage and judgements- based infringement of any patent to goods specified in this order or the ordinary use or operation of such goods by the county or use or operation of such goods in advance with the bidder's direction. Projects Over S50.000: In contracts exceeding S50.000, bidder must furnish a bid bond or cashier's check in the amount of 5% of the bid with bid submission. In contracts exceeding 550,000, successful bidder must be able to bond. (Performance, Maintenance and Payment Bonds) Successful bidder will be required to furnish their own Workmen's Comp and General Liability Insurance as required by Oklahoma State Law and by Rogers County. Any bid received by the County more than 96 hours, excluding Saturdays, Sundays and holidays before the time set for the opening of bids or any bid received after the time set for closing shall not be considered by the County and shall be returned unopened to the bidder submitting same.
