The successful bidder shall be required to furnish Performance, Maintenance and Payment Bonds on the forms provided by the School Board and written in accordance with state law. The Owner reserves the right to reject any and all bids. The Owner will have the right to reject any or all Bids that are nonresponsive or for just cause and in particular to reject a Bid not accompanied by a required bid security or data or information required by the Bid Form or reject a Bid which is in any way incomplete, irregular, or not in compliance with the Bidding Documents. The successful Bidder shall be required to furnish a Performance and Payment Bond written on the Owner's form by a company licensed to do business in Louisiana, in an amount equal to 100% of the Contract amount. Surety must comply with the requirements of La. R.S. 38:2219. By submitting a Bid, a Bidder agrees, in the event awarded the Contract, to pay as Liquidated Damages the sum specified in the Bidding Documents for each consecutive calendar day for which the Work is not complete beginning with the first day beyond the contract time established for the Contract. In addition, by submitting a Bid, a Bidder agrees to pay the amount of Liquidated Damages in the sum in the Bidding Documents for each consecutive calendar day for which any item on the list of items to be completed or corrected (Punch List) is not complete beginning with the forty-sixth (46) day after the date of the recording of the Certificate of Substantial Completion. Said amounts are agreed as damages stipulated and not by way of penalty and agreed upon in advance by the submission of a Bid.
