Bids received after the time announced for the opening will not be considered and will be returned, unopened, to the bidder.Said bids shall conform to and be responsive to the Specifications and Contract Documents for the work as heretofore approved by the Agency.General work description: The work to be done consists in general of but is not limited to cold-plane 3 inches of existing roadway surface, proof roll subgrade, installation of hot mix asphalt; reconstruction of x-gutters, curb and gutters, and ADA curb ramps; installing traffic stripes, pavement markings, and roadside signs. Other items or details, not mentioned above, that are required by the typical sections, Standard Specifications or these special provisions shall be performed, placed, constructed or installed. Perform Roadway Finishing as specified in Section 22 of the Standard Specifications. All work must be completed within thirty (30) working days after the commencement date stated in the Notice to Proceed. Bids must be submitted on the Bid Proposal form provided by the City of McFarland. Each bid must be accompanied by one of the following forms of bidder's security equal to at least ten percent (10%) of the bid amount: (1) cash; (2) a cashier's check made payable to the City of McFarland; (3) a certified check made payable to the City of McFarland; or (4) a bidder's bond signed by a surety insurer who is licensed in California, made payable to the City of McFarland. Each bidder must be a licensed contractor as required by law at the time the contract is awarded. The bidder who is awarded the project contract will be allowed pursuant to Public Contract Code Section 22300 to substitute securities for the payment of funds withheld under the contract. In addition, the successful bidder must furnish: (1) a faithful performance bond in the amount of one hundred percent (100%) of the contract price; and (2) a payment bond (also referred to as a labor and material bond) in the amount of one hundred percent (100%) of the contract price. All bonds must be in a form approved by the City of McFarland and must conform to California law (see Code of Civil Procedure section 995.010 et seq.).All documents submitted in compliance with the requirements of this bid package and the contract must be scannable and photocopiable. The City hereby invokes its protest right under California Code of Civil Procedure 995.660 for any proposed surety bond submitted in satisfaction of the requirements of this agreement if the submitted bond is not issued by an admitted surety rated A-, VII or better by Bests Rating Service. Bids shall be sealed in an envelope marked City of McFarland 2023 Street Rehabilitation - Various Locations addressed to the City of McFarland Public Works Department attention City Clerk, and be delivered thereto on or before the day and hour set for the opening of bids in the notice inviting sealed bids, and shall bear the name of the bidder. It is the SOLE responsibility of the bidder to see that his bid is delivered and received in proper time. Any bid received after that scheduled closing time for receipt of bids shall be returned to the bidder unopened. The contractor shall possess a Class A license at the time this contract is awarded. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. Inquiries or questions based on alleged patent ambiguity of the plans, specifications or estimate must be communicated as a bidder inquiry prior to bid opening. The City of McFarland affirms that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation. The City reserves the right to reject any and all bids, to waive any irregularities or informality in a bid and to make awards to the lowest responsive, responsible bidder as it may best serve the interest of the owner. Each bid shall be submitted only on the prescribed bid form included with the contract documents. Pursuant to California Labor Code Sections 1770, 1773, 1773.1, 1773.6, and 1773.7, as amended, the applicable prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations and available from the California.Future effective general prevailing wage rates which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. The U.S. Department of Transportation (DOT) provides a toll-free "hotline" service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 a.m. and 5:00 p.m., Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the "hotline "to report these activities. The "hotline" is part of the DOT's continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and caller anonymity will be respected. *The value for this project is based on a financial range.
