To be given consideration, requests for interpretations must be received in time to allow preparation of written response at least 5 days prior for receipt of bids. The project will consist of construction of the following work: Replacement of approximately 4,250 linear feet of 8-inch inch diameter water line with 12-inch diameter water line. Herbert F. White, III, P.E. is the point of contact. Bid Security: Bids shall be accompanied by a certified check or an acceptable bid bond in the amount of 5 percent of the base bid. A Performance Bond and a Payment Bond will be required in the amount of 100 percent of the bid. MBE/WBE firms are encouraged to submit bids. Bidders must comply with the following: the President's Executive Order # 11246 prohibiting discrimination in employment regarding race, color, creed, sex, or national origin; the President's Executive Orders # 12138 and 11625 regarding utilization of MBE/WBE firms; the Civil Rights Act of 1964; the Davis-Bacon Act; and Section 70901 of P. L. 117-58 of the Bipartisan Infrastructure Law, 2021, Infrastructure Investment and Jobs Act, Build America/Buy America Act. Bidders must certify that they do not or will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed, or national origin. We further agree that if awarded the contract, we will commence the work on the date stated in the "Notice to Contractor to Proceed," and will prosecute the work and shall be substantially complete as defined in the general conditions within 300 calendar days and complete all obligations within 330 calendar days. The Owner and Contractor recognize that time is of the essence with this agreement and that the Owner will suffer financial loss if the work is not completed within 300 calendar days for all work associated with this project. They also recognize the delays, expense, and difficulties involved in proving the actual loss suffered by the Owner if the work is not completed on time. Accordingly, instead of requiring any such proof, the Owner and Contractor therefore agree that, as liquidated damages for delay (but not as a penalty), the Contractor shall pay the Owner one thousand dollars ($1,000.00) for each day that expires after the time specified for substantial completion of this project.
