The work shall be completed within one hundred eighty (180) calendar days, to begin five (5) days after the "Notice to Proceed" has been issued. No bidder may withdraw his bid within forty-five (45) days after the actual date of the opening thereof. Please note that funding for the improvements will be provided by the New York State Clean Water and Drinking Water State Revolving Fund. Therefore, the following requirements are to be complied with. Further information regarding these requirements is contained in the project contract book as Appendixes "C" and "E". o Minority & Women-Owned Business Enterprises (MWBE) Program o Equal Employment Opportunity (EEO) Program o Disadvantaged Business Enterprises o Davis-Bacon Prevailing Wage (DBRA) Requirements o American Iron and Steel Requirements The Town Board reserves the right to consider informal any bid not prepared and submitted in accordance with the provisions of the specifications and contract documents, and may waive any informalities, make an award to other than the low bidder, should it be in the best interest of the Town, or reject any and all bids. Please be advised that in accordance with a resolution adopted by the Cheektowaga Town Board on December 23, 2004, effective December 24, 2004, and as amended by Town Board Resolution dated February 23, 2008, contractors on all construction contracts with a value in excess of $1,000,000 and up to $3,000,000 must have Apprenticeship Agreements appropriate for the type and scope of work to be performed that have been registered with and approved by the New York State Commissioner of Labor in accordance with Article 23 of the New York Labor Law. Material suppliers and anyone returning the Specifications before the bid opening will be classified as non-bidders.
