Spencer Road Reconstruction The Owner reserves the right to waive any informalities or to reject any or all bids. No Bidder may withdraw his bid within 60 days after the actual date of the opening thereof. The following are attached to and made a condition of this Bid. (a) Required Bid Security in the form of 5% of total agreed bid. (b) A tabulation of Subcontractors, suppliers and other persons and organizations required to be identified in this Bid. (c) Required BIDDER's Qualification Statement with supporting data. Any BID may be withdrawn prior to the above scheduled time for the opening of BIDS or authorized postponement thereof. Any BID received after the time and date specified shall not be considered. No BIDDER may withdraw a BID within sixty (60) days after the actual date of the opening thereof. Should there be reasons why the contract cannot be awarded within the specified period, the time may be extended by mutual agreement between the OWNER and the BIDDER. BIDDER agrees that the Work: Shall be substantially completed in 3 phases: Phase 1: Shall be completed by November 30th, 2024. Phase 2: Shall be completed within 50 working days. Work may be suspended for the winter before starting phase 2. Phase 3: Shall be completed within 50 working days upon completion of Phase 2, and ready for final payment in accordance with paragraph 14.07 of the General Conditions. Contract must be signed/approved prior to start date. BIDDER accepts the provisions of the Agreement as to liquidated damages in the event of failure to complete the Work on time. Bid Notes: Each sealed envelope containing a BID must be plainly marked on the outside as BID for SPENCER ROAD RECONSTRUCTION - SE 14TH TO E 1ST STREET and the envelope should bear on the outside the name of the BIDDER, his address, his license number if applicable and the name of the project for which the BID is submitted. If forwarded by mail, the sealed envelope containing the BID must be enclosed in another envelope addressed to the OWNER at City of Newton, P.. Box 426, Newton, Kansas 67114.
