Oral statements regarding this RFQ by any persons should be considered unverified information unless confirmed in writing. A statement setting forth changes in other materials, equipment or other portions of the work including changes in the work prompted by the substitution shall be included. The burden of proof of the merit of the proposed substitution is upon the proposer. The City's decision of approval or disapproval of a proposed substitution shall be final. The proposal must be received no later than through the City's online bid provider, electronically. It is solely the responsibility of Proposer to see that its proposal is properly submitted to electronically in proper form and prior to the stated closing time. It is the bidder's responsibility to become familiar with the contract documents in their entirety. All forms in the bid booklet must be properly completed to be deemed responsive. The City reserves the right to award its total requirements to one bidder, or to apportion those requirements among several Bidders as the City may deem to be in its best interests. The award of this contract is subject to available budget adequate to carry out the provisions of the proposed agreement including the identified scope of services. The City has established a local preference to vendors located within the City limits of Ontario a 1 3/4% advantage in the City's determination of low bid, and a 3/4% advantage of vendors outside the City but within the County of San Bernardino.
