The work to be constructed hereunder is located at Arovista Park in the City of Brea, California. The Project site is in the Arovista Park Parking Lot adjacent to the Brea Senior Center and Skate Park off of Sievers St. The project generally consists of, but is not limited to, mobilization, demolition, PCC walkways, PCC curbs, PCC curb and gutter, other improvements and work as defined within the Specifications and as shown on the Plans. In accordance with provisions of Section 3300 of the California Public Contract Code, the AGENCY has determined that the Contractor shall possess a valid California Contractors License Class A (General Engineering) or Class C-8 (Concrete Contractor) or Class C-12 (Earthwork and Pavement Contractor) or combination thereof with the use of subcontractors with the required CA license to perform each specific Scope of Work as listed in the Proposal Section C of the Specifications at time of Bid. Failure to possess such license(s) at time of Bid may render the bid non-responsive and bar the award of the contract to that non-responsive Bidder. The successful Contractor and his subcontractors will be required to possess business licenses from the AGENCY. The Prime Contractor bidding on this Project shall self-perform a minimum of 30% of the Scope of Work. Registration with the Department of Industrial Relations: The Bidders attention is directed to Labor Code Section 1725.5, which provides that a contractor or subcontractor shall not be qualified to bid on, be listed in a Bid proposal, subject to the requirements of Public Contract Code Section 4104, or engage in the performance of any contract that is subject to Labor Code Section 1720 et seq., unless currently registered and qualified to perform public work pursuant to Labor Code Section 1725.5. In Pursuant to California Labor Code Sections 1770, 1773, 1773.1, 1773.6, and 1773.7, as amended, the applicable prevailing wages for this project have been determined. It shall be mandatory upon the contractor to whom the contract is awarded and upon subcontractor under him to pay not less than the higher of the Federal and the State prevailing wage rates to all workers employed by them in the execution of the contract. The applicable Federal prevailing wage rates are those that are in effect ten (10) calendar days prior to bid opening; they are set forth on the U.S. Department of Labor. Lower State wage rates for work classifications not specifically listed in the Federal wage decision are not acceptable. The applicable State prevailing wage rates are set forth on the California Department of Industrial Relations but are not printed in the Specifications; these rates are subject to predetermined increases. Conflict of Interest: in the procurement of supplies, equipment, construction, and services by subrecipients, the conflict of interest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, officer, or agent of the sub-recipient shall participate in the selection, award, or administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved. This is a Davis-Bacon project and the Federal Regulations will be enforced. Any contract entered into pursuant to this notice will incorporate the provisions of the Federal Labor Standards. Attention is directed to the Federal minimum wage rate requirements in these Special Provisions. If there is a difference between the minimum wage rates (predetermined by the Secretary of Labor), and the general prevailing wage rates (determined by the Director of the California Department of Industrial Relations) for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The City will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes helper (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question. Bid Security: Each bid shall be accompanied by bid security in the form of a cashiers check, certified check or bid bond in the amount of 10% of the total bid amount. All cashiers checks or certified checks must be drawn on a responsible bank doing business in the United States and shall be made payable to THE CITY OF BREA. A bonding company admitted and licensed to do business in the State of California must issue bid bonds. Bids not accompanied by the required bid security shall be rejected. Cash and personal or company checks are NOT acceptable. Questions regarding the bid documents (i.e. plans, specifications, contract documents, bid forms, etc.) will be received by the Engineer up to ten (10) working days prior to the bid opening Payment Bond and Performance Bond: A Payment Bond and a Performance Bond, each in the amount of 100% of the contract amount, will be required of the Contractor. Retention: In accordance with the Contract, five percent (5%) of any progress payment will be withheld as a retention. Pursuant to Section 22300 of the Public Contract Code, at the request and expense of the Contractor, approved securities equivalent to the amount withheld may be deposited with the AGENCY or with a state or federally chartered bank as the escrow agent, and AGENCY shall then pay such moneys to the Contractor. All Bonds Issued Shall Be From a Bonding Company Admitted and Licensed to Do Business in the State of California. The Agency Reserves the Right to Reject Any Bid or All Bids and to Waive Any Informality or Irregularity in Any Bid and to Take All Bids Under Advisement for a Maximum Period of 60 Days. Any Contract Awarded Will Be Let to the Lowest Responsive and Responsible Bidder. No Bid Shall Be Considered Unless It is Prepared on the Approved Proposal Forms in Conformance With the Instructions to Bidders.
