BID PREPARATION: Bid preparation will be in accordance with Section 00 21 13 - Instructions toBidders, bound in the Project Manual. BID GUARANTEE: Proposals shallbe submitted with Proposal Security in the form of Certified Checkor acceptable Bid Bond in anamount equal to at least five percent (5%) of the base bid; suchsecurity is to be forfeited as liquidated damages, not penalty, byany bidder who fails to carry outthe terms of the proposal. The BidBond, if used, shall be payable tothe Owner. Bonds on the projectmust be received on or before theperiod scheduled for the projectand no bid may be withdrawn afterthe scheduled closing time for theproject. Bids must be firm for aperiod of forty-five (45) days afterthe scheduled time of opening. PERFORMANCE-PAYMENT BOND:A one hundred percent (100%)Performance-Payment Bond issuedby a surety company authorized todo business in the State of Mississippi will be required within ten(10) days after the successful bidder has been notified of the awardof the contract to him. CERTIFICATE OF RESPONSIBILITY:All bids submitted by a prime orsubcontractor for public works orpublic projects where said bid is inexcess of fifty thousand dollars($50,000.00) to perform contractsenumerated in Section 31-3-21,Mississippi Code of 1972, shallcontain on the outside or exteriorof the envelope or container ofsuch bid the contractor's currentcertificate number. No bid shall beopened or considered unless suchcontractor's current certificatenumber appears on the outside orexterior of said envelope or container or unless there appears astatement on the outside or exterior of such envelope or containerto the effect that the bid enclosedtherewith does not exceed fiftythousand dollars ($50,000.00).NOTE: When bids are submittedelectronically, the requirement forincluding on the exterior of the bidenvelope the contractor's currentcertificate of responsibility numberor a statement that the bid enclosed does not exceed fifty thousand dollars ($50,000.00) shall bedeemed fulfilled and the bid incompliance by including the sameinformation as an attachment withthe electronic bid submittal. AFTER CONTRACT AWARD: Thesuccessful bidder shall provide aschedule of values for this projectfor approval no later than ten (10)days after notification of the awardof the contract for construction. The Owner reserves the right toreject any or all bids and to waiveirregularities.
