The General Terms and Conditions, Specifications, Special Provisions, Bid Form, Affidavit and Contract (if applicable) are on file and available to any interested person requesting a copy via email at purchasing@ohioturnpike.org. These documents will be forwarded, upon request and without charge, to any prospective Bidder. The Small Business Enterprise Goal (including SBE, DBE and EDGE) is waived. Each Bid must be on the form prescribed by the Commission and must comply with the terms and conditions set forth in all of the documents provided with this Bid Invitation. The award of the Contract, if any award be made, will be to the lowest responsive and responsible Bidder therefor whose Bid complies with all the prescribed requirements. The Commission reserves the right to reject any and all Bids and to waive minor technicalities or minor irregularities. Rejection of Bids Containing Alterations, Erasure, or Irregularities: Bids may be rejected if they show any alteration of form; make any additions not called for; are made conditionally; are incomplete; or are submitted with erasures or irregularities of any kind. Bids may also be rejected as a result of mutual mistake(s) as to any material element or elements of the Bid.Bid Guaranty: IF SPECIFIED IN THE NOTICE TO BIDDERS, NO BID WILL BE CONSIDERED UNLESS ACCOMPANIED BY A BID GUARANTY IN THE PROPER AMOUNT. THE BID GUARANTY MAY BE IN THE FORM OF A COMBINED BID GUARANTY/PERFORMANCE BOND OR CERTIFIED CHECK, CASHIER'S CHECK OR LETTER OF CREDIT AND SHALL BE IN THE AMOUNT CALLED FOR IN THE NOTICE TO BIDDERS. If the Bidder wishes to submit a Bid Guaranty Bond, such Bond must be on the form approved by the Commission, and the appropriate Power of Attorney must accompany said bond or the Bid shall be rejected. A copy of said approved form is included in these Documents. If the Bidder wishes additional copies, they must be obtained from the Commission's Procurement Manager by making a written request to purchasing@ohioturnpike.org. Said Bid Guaranty will be held by the Commission as a guaranty that, if the Bid secured thereby be accepted, the Bidder will furnish the Performance Bond and Contract with the Commission in accordance with the Contract Documents The Bid Guaranty of the Bidder to whom the Contract is awarded will be returned promptly after having furnished the required Performance Bond. Notice of Intent to Award: The Commission shall notify the apparent successful Bidder that, upon satisfactory compliance with all conditions precedent within the time specified, the Bidder will be awarded the Contract, through the issuance of a Purchase Order. The Commission reserves the right to rescind any Notice of Intent to Award. P. Questions and Inquiries Concerning Bid or Contract: If a Bidder has a question or inquiry concerning the Bidding Documents or concerning any technical requirements relating to the equipment or services to be furnished, inquiry should be made to (purchasing@ohioturnpike.org). Responses will be provided to all Bidders communicating an interest in the Bid Invitation. Inquires may be made up until the day prior to Bid Opening, subject, however, to the provisions contained in the Instructions to Bidders (Part 2) at Section B concerning the furnishing of Addenda and Section J covering the Opening of Bids. If the Contract has been awarded, all inquiries should be directed to the Commission's Chief Engineer, at the Commission's Administration Building (440) 234-2081.
