RFQ-CMAR - DPS Tucson Forbes Office Renovation Liquidated Damages Failure of Contractor to complete the Work within the time specified in the Contract, including any and all properly authorized extensions of time, will result in damages to the Agency with regard to occupancy, operations, and the specific benefits of public services, that are hereby communicated to the Contractor and contemplated by the Contractor as nullifying the inherent benefit of Agency's contractual bargain. Accordingly, as such damage is difficult to specify and formulate, Agency and Contractor agree that Contractor shall pay to Agency liquidate damages for each calendar day the Work remains incomplete beyond the date fixed for Substantial Completion. Whether the Offer was in conformance with the requirements contained in the Scope of Work, Terms and Conditions, and Instructions for the Solicitation including its Amendments and all documents incorporated by reference The State reserves the right to reject any offer which does not demonstrate financial stability sufficient for the scope of this contract award.
