Sealed bids will be received by the Borough Clerk for the Borough of Fair Lawn (the "Borough"), Bergen County, New Jersey at the Municipal Building, Council Chambers, 8-0l Fair Lawn Avenue, Fair Lawn, New Jersey 07410, at which time bids will be opened and read aloud for Solid Waste and Recyclable Materials Collection, as more fully described in the bid specifications. No bids will be considered after the date and time set forth above. Bids will have the date and time stamped upon receipt. Bidder is solely responsible for the timely delivery of the bid and no bids shall be considered that are presented after the public call for receiving bids. Any Bid received after the date and time specified will be returned, unopened to the Bidder. Prospective Bidders must contact the Borough Clerk's Office, telephone 201-794-5340, between the hours of 8:30 A.M. and 4:30 P.M., prevailing time, Monday through Friday, excluding legal holidays or by emailing bids@fairlawn.org to pick-up or discuss arrangements for the delivery of the bid package. Prospective bidders shall telephone at least twenty-four (24) hours or at least one (1) business day in advance to reserve a bid package. The Borough assumes responsibility only for mailing the bid package to the prospective bidder and not for proper and timely delivery of the bid package. A certified check, cashier's check or Bid Bond in the amount of ten percent (10%) of the bid, but not in excess of Twenty Thousand Dollars ($20,000.00), must be submitted with the bid, guaranteeing that if a contract is awarded, the bidder shall execute the contract and deliver the bond(s) required by the bid specifications. The Bid Bond must be written by a surety company listed on the Federal Treasury List (Environmental Protection Agency Circular 570-Surety Companies Acceptable on Federal Bonds) as required by N.J.A.C. 7:22-3.17 (g). A bid must be accompanied by a Consent of Surety and the surety company shall be bound to furnish performance bonds, each in an amount equal to one hundred percent (100%) of the Contract. Consent of Surety must be written by a surety company listed on the Federal Treasury List (Environmental Protection Department Circular 570- Surety Companies Acceptable on Federal Bonds) as required by N.J.A.C. 7:22-3.17 (g). Bidders shall submit an original of their respective bids in a sealed envelope bearing the name and address of the bidder and the words "Bid for Solid Waste and Recyclable Materials Collection" clearly visible on the outside thereof. The successful Bidder shall submit copies of the New Jersey Business Registration Certificate(s) for itself and all subcontractors prior to award of a contract by the Borough. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27-1 et seq., and N.J.A.C. 7:26H-1.1 et seq. The Borough reserves the right to reject any or all of the bids or waive any informalities therein pursuant to and in accordance with applicable law.
