Sealed bid proposals can also be hand delivered from 1:45 PM to 2:00 PM, on Wednesday, October 18, 2023, to the Alabama State Port Authority in the International Trade Center building, 250 North Water Street, 1 st Floor Killian Room, Mobile, AL. Faxed or electronic submitted bids will not be accepted. The right is reserved, as the interest of the Alabama State Port Authority may require, to reject all bids through a Notice of Non-award or otherwise, and to waive informalities in bids received. ASPA reserves the right to procure other contracts to perform similar work; as such, no minimum work or quantities within this contract are guaranteed. The work will require providing and operation amphibious excavators at the direction of the ASPA assigned representative. The work consists principally of providing bonds, labor, materials, equipment, and supervision necessary for the excavation of dredge material, construction of levees and dikes, construction of trenches to facilitate drainage, and other tasks related to the management of a dredge material management area. The contract will include work at any or all of the following locations: McDuffie Terminal DMMA, Pinto Terminal DMMA, and/or Blakeley DMMA which are in Mobile Alabama (see vicinity map). All bidders should carefully examine the site of the proposed work and thoroughly review the contract requirements prior to the submission of a bid proposal and failure to do so does not alieve the bidder of any responsibility. Each bidder shall satisfy oneself as to the character, quality, and quantities of work to be performed, and as to the requirements of the proposed contract. The submission of a proposal shall be proof that the bidding Contractor has made such examination and is satisfied as to the conditions to be encountered in performing the work and as to the requirements of the proposed Contract. All bidding Contractors must hold a current license from the State Licensing Board for General Contractors, Montgomery, Alabama with one of the following classifications: H/RR: Heavy & Railroad Construction, H/RR-S: Heavy & Railroad Construction - Earthwork, or H/RR-S: Heavy & Railroad Construction - Dredging, Levees, and Dikes. This contract shall be effective for one (1) year beginning on the issuance date of the "Notice to Proceed". The Owner and Contractor will have the option to renew the contract for four (4) additional years. The renewals shall be mutually agreed upon and may not exceed a total of five (5) years from the issuance of the original "Notice to Proceed". Rates may be adjusted by the method stated within Division V at each yearly renewal. For purposes of bid evaluation only, estimated quantities are shown on page 4 in the Schedule of Prices. A prime factor in the analysis of the bids will be the cumulative cost for performing this scenario of work at the unit prices quoted. A Guarantee will be required with each bid as follows: At least five (5%) percent of the amount bid, but in no event more than Ten Thousand ($10,000) Dollars, shall be furnished in the form of a certified check or bid bond payable to the Alabama State Port Authority. A Performance Bond in an amount not less than the sum bid will be required at the signing of the contract and, in addition, a bond in an amount not less than One Hundred (100%) percent of the contract price, insuring payment of all labor and material. No bid will be considered unless the bidder, whether resident or non-resident of Alabama, is properly qualified to submit a proposal for this work in accordance with all applicable laws of the State of Alabama. This shall include evidence of holding a current license as required from the State Licensing Board for General Contractors, Montgomery, Alabama. Also, non-residents of the State must show evidence of having qualified with the Secretary of State to do business in Alabama.
