**As of September 20, 2023, Project has been awarded. Award amount is $987,306.03** All sealed bids from vendors and/or contractors will be accepted at the time of the Bid Opening only when called by the Borough Clerk. It is the bidder's responsibility that bids are presented to the owner at the time and at the place designated. Bids may be hand delivered or mailed; however, the owner disclaims any responsibility for bids forwarded by regular or overnight mail. If the bid is sent by express mail service, the designation in the preceding paragraph must also appear on the outside of the express mail envelope. Bids received after the designated time and date will be returned unopened. Sealed bids forwarded to the owner before the time of opening bids may be withdrawn upon written application of the bidder who shall be required to produce evidence showing that the individual is or represents the principal or principals involved in the bid. Once bids have been opened, bids may be held by the Borough for a period of sixty (60) days from the date of the receipt of bids for the purpose of reviewing the bids and investigating the qualifications of the bidders, prior to awarding of the contract Each proposal must be accompanied by a Surety's Consent and a Certified Check, Cashier's Check or Bid Bond at the Bidder's discretion for not less than ten percent (10%) of the amount of the bid, payable to the Borough of Spotswood, New Jersey except that the amount of the check shall not exceed $20,000. The same Surety shall be bound to furnish Performance, Maintenance and Payment Bonds that hereinafter may be required. The successful Bidder will be required to furnish, within ten (10) days after the award, a Surety's Corporation Performance Bond equal to one hundred percent (100%) of the Contract Price, such Surety Company to be acceptable to the Borough of Spotswood and authorized to do business in the State of New Jersey. Bids must be made on the Standard Proposal Form provided in the manner designated herein. All prices, amounts, and signatures must be written in ink or machine printed. Bids containing any changes, alterations, whiteouts or strikeouts in the bid must be initialed in ink This work is subject to the provisions of the New Jersey Prevailing Wage Act. All bidders on this contract for public work will be required to name all subcontractors at the time the bid is made. At the time of bid opening, contractors shall submit to the public entity the Certificates of Registration and a valid Public Works Contractor Registration for themselves, and all subcontractors listed in the bid proposal. No contractor or subcontractor shall engage in the performance of public work subject to this contract unless the contractor and all subcontractors are registered under the Public Works Contractor Registration Act and hold a valid State of New Jersey Business Registration Certificate. Bids without both valid documents for each contractor and subcontractor will not be considered. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. The Borough reserves the right to reject any or all Bids, to waive any informalities, or to accept the bid which, in its judgment, best serves the interest of the Borough. It is expressly required that the contractor will have the enclosed documents reviewed by an attorney of his own selection. Such legal review will permit the contractor to have a clear evaluation of the legal adequacy and intended requirements of the enclosed material, and also establish any areas whose additional explanation or clarification is required prior to bid submission.
