**As of September 15, 2023, Project has been awarded. Award amount is $708,150.25** The Scope of Work shall include, but not be limited to: roadway improvements to approximately 2,700 LF on Myrtle Avenue from Glen Place to the Maplewood border. The roadway improvement will generally consist of full width roadway milling, 2" thickness and resurfacing with HMA 9.5M64 surface course, removal of the existing monolithic concrete curb and gutter and replacement with granite block curb, driveway apron repairs, barrier-free concrete curb ramps, new drainage structures and pipe, upgrading old drainage structures, replacing manhole covers, full depth pavement reconstruction, as needed, pavement markings, traffic striping, grass restoration with topsoil and seeding all disturbed areas, and/or other incidental construction as shown or indicated on the plans and/or as described in the Specifications. The term of Contract for the Work shall be for a period anticipated to commence upon the Owner's issuance of a Notice to Proceed to the Contractor. Bids shall be handwritten on the form furnished by the Township in the Proposal Section of the Contract Documents, as that term is defined in the Contract referenced herein, and prepared and submitted in the manner designated. In the event that a potential bidder obtains the Contract Documents in any manner other than as specified herein, the Township will not have the contact information of the potential bidder for purposes of issuing bid addenda, if any. The non-receipt of any addenda (in the event that any addenda are issued) and the failure of the bidder to acknowledge receipt of any and all addenda at the time of bid shall be considered a fatal defect in such Bidder's submission and said bid shall be immediately rejected. Therefore, if a potential Bidder obtains the Bid Documents in any manner other than specified herein, said Bidder shall promptly provide written notice to the Township accordingly. Submission of a proposal without the bid bond shall be considered a non-responsive bid and shall be rejected. A certified check, cashier's check, or Bid Bond in the amount of ten percent (10%) of the Bid, as specified by the Bid submitted by the Bidder, but not in excess of $20,000.00 whichever is lower, must be submitted with the bid as a guarantee that if a contract is awarded by the Township, the Successful Bidder shall execute the Contract required by the Contract Documents. Where the Contract Documents so require, a Consent of Surety in the amount equal to 100% of the bid shall also be required. The surety or sureties issuing any Bid Bond and/or Consent of Surety as required by the Contract Documents shall be licensed and/or authorized to transact business in the State of New Jersey and shall be acceptable to the Township. Contractor shall be required to comply with the requirements of the Law Against Discrimination, N.J.S.A. 10:5-31 et.seq. and the Equal Employment Opportunity and Affirmative Action Rules set forth at N.J.A.C. 17:27-1, et.seq. and the Americans with Disabilities Act of 1990, 42 U.S.C. 12.101 et.seq., as applicable. Additionally, a copy of the Business Registration Certificate issued by the New Jersey Department of Treasury, Division of Revenue, for the Bidder and subcontractors must be submitted prior to award of the Contract in conformance with N.J.S.A. 52:32-44. The Successful Bidder, as that term is defined in the Contract, shall be required to comply with all provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11_56.25. et.seq, as applicable, and all other Applicable Laws. Bids shall be accompanied by all information requested in the Contract Documents and shall be enclosed in a sealed envelope addressed to the Township Clerk, bearing the name and address of the Bidder, and designated as follows: "MYRTLE AVENUE ROAD IMPROVEMENTS" The Township expressly reserves the right to reject any and all bids and/or to waive informalities in accordance with the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et.seq. Contract Documents may be obtained by contacting the Engineering Department of the Township of Millburn, 375 Millburn Avenue, Millburn, NJ 07041, during regular business hours between 9:00 a.m. and 3:30 p.m., or by submission to the Township of a written request on or after Thursday, August 10, 2023.
