CLARIFICATION DEADLINE 8/23/2023 12:00 PM Click on the "Bids" tab then "check Open for Bidding" status checkbox. Once registered at the PennBID website, bidders can obtain all project documents and submit and update their bids online. Sealed hard-copy bids may also be submitted and must be received at the offices of RETTEW Associates, Inc., 330 Innovation Blvd, Suite 104, State College, PA 16803 no later than the time and date above. If the Bid is sent through the mail or other delivery system, the sealed envelope shall be enclosed in a separate envelope with the notation "BID ENCLOSED" on the face of it. The Project consists of the replacement of approximately 1,300 feet of waterline. The McClure Municipal Authority is utilizing federal funds for this project, and Snyder County has adopted a Minority and Women Business Enterprise (MBE/WBE) plan in accordance with Executive Orders 11625, 12138, and 12432 and a Section 3 Action Plan in accordance with Title 24 Part 135 Code of Federal Regulations. As such, the bidders/offerors must submit documentary evidence of minority and women business enterprises and Section 3 business concerns who have been contacted and to whom commitments have been made. Documentation of such solicitations and commitments shall be submitted with the bid. Moreover, the Contractor shall strive to meet the MBE goal of 5% and the WBE goal of 3% for contracts of $25,000 or more. For projects which the amount of HUD or CDBG funding exceeds $200,000 the CONTRACTOR must attempt to meet the minimum numerical goals of which 25% or more of the total number of labor hours worked by all workers. Bids shall remain open for a period of 60 days from the date of Bid opening unless award is delayed by a required approval from a governmental agency, the sale of bonds, or the award of a grant or grants, in which event the Bids shall remain open for a period of 120 days from the date of Bid opening. Bids may not be withdrawn during this period. See Instructions to Bidders for other provisions on the time available for acceptance of Bids. All Bidders must bid on all items listed on the Bid Form. The successful Bidder shall be required to furnish performance and payment bonds in the amount of 100% of the Contract Price. The successful Bidder shall substantially complete the project within 455 calendar days of receipt of the Notice to Proceed. This contract is subject to the following: the Davis-Bacon Act conditions; the Federal Occupational Safety and Health Act of 1970 (OSHA) conditions; the Pennsylvania Act 229 of 2002; the Pennsylvania One Call Act, also known as the Underground Utility Line Protection Law, Act 287 of 1974, as amended; the Pennsylvania Human Relations Act 222 Conditions; and the non-discrimination in Employment/Contract Compliance Regulations Conditions; requirement of a Non-Collusion Affidavit; and the Pennsylvania Public Works Employment Verification Act, 43 P.S. 167.1-167.11. The McClure Municipal Authority reserves the right to accept or reject any or all Bids.
