South Kentucky Avenue Roadway Improvements. The Contractor shall provide and furnish all of the necessary labor, supervision, material, tools, expendable and permanent equipment, and all utility and transportation services required to perform and complete in a workmanlike manner. Bid security shall be in an amount equal to at least five percent (5%) of the Maximum Bid Price (Base Bid Plus Alternates), payable without condition to the City, as a guaranty that the Bidder, if awarded the Contract, will promptly execute the Agreement in accordance with the Bidding Documents, and will furnish all bonds and insurance as required. Performance and Payment Bonds must be in an amount equal to 100 percent of the Contract Amount each. To begin work after the issuance of a Notice to Proceed, unless otherwise provided, and substantially complete the Work within 90 calendar days of the date of the Notice to Proceed. Final completion will be within 30 calendar days of substantial. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree that as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER $1,000.00 for each calendar day that expires after the time specified in Paragraph C for substantial completion until the work is substantially complete. The City reserves the right to accept or reject any or all bids in whole or in part with or without cause, to waive minor informalities, or to accept the bids(s) which, in its judgment, best serves the interest of the City.
