The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. Award will be made to the offeror who represents the best value to the Government as outlined in accordance with the criteria set forth within the solicitation. The project consists of contractor furnishing all labor, materials, tools, and equipment necessary to repair asphalt pavement cracking and options to apply slurry sealant around the airfield apron at 164th Airlift Wing Tennessee Air National Guard Base, Memphis, TN. The existing apron asphalt is approximately 14 years old with increasing cracking over time. Asphalt crack repair to include saw cutting and hot patch and applying slurry sealant are all part of this project. This type of work on the apron asphalt will be performed in phases working around the aircraft schedule. Per the attached Performance Work Statement (PWS). The Government will award a contract resulting from this solicitation to the responsible bidder whose offer conforming to the solicitation will be most advantageous to the Government, considering price and other price-related factors. The contracting officer will award to the offeror whose offer represents best overall value to the Government. The Government intends to make award without discussions. However, the Government reserves the right to hold discussions if it is in the best interest of the Government to do so.
