The project shall be defined as providing supplies, machinery, equipment, tools, superintendence, labor, insurance, and other accessories and services necessary to rebuild the pump house building. All bids for projects exceeding $100,000 will be accompanied by a bid bond payable to the CITY, or a cashier's check issued by a solvent bank, for five percent (5%) of the total amount of the bid, including all bid alternates. Bid bonds will be returned to all unsuccessful bidders upon notification of award to the successful bidder. The bid bond will be returned to the successful bidder upon receipt of the executed contract and payment and performance bond. The successful bidder for all projects exceeding $50,000 will be required to furnish a surety bond, or bonds, as security for faithful performance of the contract and for the payment of all firms or persons performing labor or furnishing materials for the work performed under the contract. The surety on such bond, or bonds, shall be a surety company satisfactory to the CITY. The CONTRACTOR shall pay wages not less than the prevailing wage for the type of work performed under this agreement as determined by the Missouri Department of Labor and Industrial Relations, Division of Labor Standards. The CONTRACTOR further agrees to comply with Prevailing Wage Laws as prescribed in Section 290.290 RSMo, and to ensure compliance with the aforementioned statutes by all sub-contractors performing work under this agreement. The CONTRACTOR will pay the CITY as and for liquidated damages, one-hundred dollars ($100.00) per day, or portion of day, if a worker is paid less than the prevailing rate for any work done under the contract by the CONTRACTOR or by any subcontractor. The Contractor will forfeit a penalty to the CITY of $2,500 plus an additional $100 for each employee employed by the contractor or subcontractor, or each calendar day, or portion thereof, such employee is employed without the required training. The contractor will be required to provide a lien waiver from the contractor, all subcontractors, and all material providers performing work or providing materials under this contract prior to receiving the 5% payment retainage for this contract. All contractors or sub-contractors performing work under this contract will be required to provide evidence of valid licenses as required by the State of Missouri and the CITY. The CITY will award this contract based on the lowest bid and best qualified bidder. When selecting the lowest bid and best qualified bidder, the CITY may consider contract participation by local companies and the effect of the contract award on local employment. No interpretation of any plans, specifications, or other condition will be made verbally to any bidder. Every such request for interpretation shall be made in writing via e-mail to llacy@farmington-mo.gov, and shall be made not less than five business days prior to the scheduled bid opening. Any and all interpretations, or addenda to the specifications, will be made in writing to all plan holders via e-mail or personal delivery not less than two days prior to the scheduled bid opening. The CITY may consider invalid any bid not prepared and submitted in accordance with the provisions hereof, and may waive any irregularities, or reject any and all bids.
