Every general bid and every sub-bid shall be accompanied by a proposal guaranty in the form of a Bid Bond, or a certified check on, or a treasurer's or cashiers check issued by, a responsible bank or trust company having offices in the Commonwealth of Massachusetts. The proposal guaranty for general bids and sub-bids shall be in the amount of five percent (5%) of the amount of the bid. Checks and bid bonds shall be made payable to the City of Chicopee , Massachusetts. A performance and Payment Bond in the full amount of the Contract will be required of the successful bidder. ttorney-in-fact who sign Bid Bonds or Payment Bonds and Performance Bonds must file with each Bond a certified and effective dated copy of their power of attorney. Minimum wage rates have been established for this project by the Commonwealth of Massachusetts. The conditions of Employment and minimum Wage Rates as set forth by the Massachusetts Commissioner of Labor and Industries are made a part of the specifications. All bidders shall submit an Affirmative Action Plan as set forth in the E.E.O. Section of the specification. This requirement is mandatory and shall not be waived. All bidders shall comply with the City of Chicopee Supplemental Equal Employment Opportunity, Anti-Discrimination Action Program. No Proposal may be withdrawn within sixty (60) days, Saturdays, Sundays, and legal holidays excluded, after the actual date of the opening for bids. The Awarding Authority reserves the right to waive any informality in or to reject any or all Proposals or to accept any Proposal which in their opinion, is in the best interest of the City of Chicopee, Massachusetts, whether or not such Proposal is the lowest bid.
