Improve 800 South roadway consisting approximately 70,000 sf of roadway to be reconstructed with new asphalt. New curb, gutter, sidewalk, and storm drain to be included. The Contract documents , consisting of Advertisement for Bids, Information for Bidders, Bid, Bid Bond, Agreement, Payment Bond, Performance Bond, Notice of Award, Notice to Proceed, Change Order, General Conditions, Supplemental General Conditions, Specifications, Drawings, and Addenda, may be obtained through online. All Bidders are required to have payment and performance bonds underwritten by a Surety Company approved by the U.S. Department of the Treasury. Each BID must be accompanied by a Bid Bond payable to the OWNER for five, (5) percent of the total amount of the BID. As soon as the BID prices have been compared, the OWNER will return the bonds of all except the three lowest responsible BIDDERS. When the Agreement is executed, the bond of the two remaining unsuccessful BIDDERS will be returned. The Bid Bond of the successful BIDDER will be retained until the Payment Bond and performance Bond have been executed and approved, after which it will be returned. A certified check may be used in lieu of a Bid Bond. A Performance Bond and a Payment Bond, each in the amount of 100 percent of the contract price, with a corporate surety approved by the U.S. Department of the Treasury (Circular 570, latest edition) will be required for the faithful performance of the contract. All bid unit prices shall be held per the bid if Notice of Award is issued on or before March 24, 2021. If the OWNER is unable to issue the Notice of Award on or before March 24, 2021, BIDDER may request a material and/or fuel price adjustment due to the delay. BIDDER must provide proof that the price of the material and/or fuel has increased from the time that the project was bid to the time that the request for adjustment is made. OWNER reserves the right to negotiate an appropriate price adjustment with the low BIDDER and to re-bid the project if an acceptable price adjustment cannot be agreed upon. BIDDER agrees that they have no claim for efforts expended if project is re-bid. OWNER will be flexible with BIDDER on construction start schedule as long as the project can be completed by June 15, 2021. Owner reserves the right to accept or reject any or all proposals, or any part of any Proposal. Owner reserves the right to waive any informality in part or in whole if it is deemed To be in the best interest of owner. Question Submission Close Date 2/15/2021 5:00 PM MST
