**As of May 08, 2020, the anticipated construction start date is in mid-June. The work to be performed under this Contract shall be commenced within ten (10) calendar days after a Notice to Proceed and completed within 30 calendar days following the timeline. Accordingly, the parties agree that the CONTRACTOR shall pay the COUNTY the sum of $100.00 as liquidated damages. This liquidated damages provision shall not preclude the COUNTY from pursuing a claim for actual damages should the COUNTY desire to pursue such claim in its sole discretion. The contractor shall furnish a surety bond in an amount at least equal to one hundred percent (100%) of the contract price as security for the faithful performance of this contract. The contractor shall also furnish a separate surety bond in an amount equal to one hundred percent (100%) ofthe contract price for the protection ofthe clients supplying labor or materials to the contractor or to any of his subcontractors, in the prosecution of the work, and shall be continued for the prompt payment of all such material furnished or labor supplied or performed in the prosecution of the work. The contractor shall also furnish a two (2) year Maintenance Bond in an amount equal to one hundred percent (100%) of the contract price. The two (2) year maintenance period shall begin on the date of final acceptance of the work. For determination of the amount of the Maintenance Bond, the contract price shall mean the final amount of the contract including all change orders and modifications. If the work shall be stopped by order of the Court or any other public authority for a period of ninety (90) days without act or fault of the contractor or any of his agents, servants, employees or subcontractors, the contractor may, upon ten (10) days notice to the County, terminate the contract, in which event the County shall pay for all work completed and any expense sustained, plus a reasonable profit.
