Preference in the award for this Contract shall be given to Indian and Alaskan Native organizations and economic enterprises. The Owner shall give preference to a 51% Indian-owned Economic Enterprise so long as the bid by this enterprise does not exceed the lowest bid submitted by more than five (5) percent. Indian-owned Economic Enterprise means any Indian-owned commercial, industrial, or business activity established or organized for the purpose of profit, provided that such Indian Ownership shall constitute not less than 51 percent of the enterprise, and that ownership shall encompass active operation and control of the enterprise. All preferences shall be publicly announced at the bid opening. Any contractor claiming Indian preference shall give evidence, as required by the Owner, to support its claim prior to bid opening. The Contractors bid must include provisions to furnish all labor, equipment, materials, and services for the performance of all work required for the construction of the Project including meeting TERO compliance requirements. The contractor shall furnish all labor, equipment, and material necessary to: Mobilize and demobilize necessary heavy equipment, including backhoe; Conduct site work including, but not limited to clearing and grubbing, and trenching/excavation; Dewater site for lift station installation; Install lift station, pumps guide rails, plumbing tree, valves and related appurtenances; Install electrical lines, conduit and connections; Install forcemain, sewer main and manholes; Install gravel, crushed rock and rick-rap; Install Fence and Gates; Perform Startup, As-Builts and O&M Manuals; Abandon existing wetwell, manholes, sewer mains and forcemains. FMTUA will award to the responsive and responsible contractor with the lowest bid. Unit prices shall include all labor, materials, equipment and miscellaneous supplies for the full scope of work.
