Proposals must be accompanied by a Proposal Guaranty or Cashier's Check, made payable to the Central Florida Expressway Authority, of not less than five percent (5%) of the total Bid. The Guaranty shall be forfeited as liquidated damages if the Proposal is accepted and the Successful Bidder fails to execute the Contract under the conditions of the Proposal and said guaranty will be returned to the Successful Bidder upon the delivery of a satisfactory Public Construction Bond. All Bids shall remain open for acceptance by CFX for ninety (90) calendar days after the day of the Bid opening. The right is reserved by CFX to reject any or all Bids. The clock will serve as the official instrument to determine when a bid is received. A submittal that is received after the date/time specified will be rejected. Rejection of a submittal under those circumstances shall not be the basis of a protest pursuant to the CFX Procedure for Resolution of Protests. The work consists of providing all labor, materials, equipment and incidentals necessary to widen the SR 429 southbound exit ramp to New Independence Parkway and the installation of traffic signals at both ramp terminals located at SR 429 and New Independence Parkway. Work also includes ITS connections, signal interconnects and roadway lighting conversion to LED luminaires. The Contract time for this project will be 120 calendar days. At the time of Bid submittal, Bidder as the "prime" contractor must be prequalified by the Florida Department of Transportation under Administrative Rule 14-22, Florida Administrative Code, in a Combination of Flexible Paving, Hot Plant-Mixed Bituminous Course and Drainage. Certification in Traffic Signals is also required; however, prequalification can be satisfied by the certification of the Bidder or by the certification of a subcontractor, a joint venture member or partner. A copy of the Bidder's current Certificate of Qualification in the specified class of work shall be submitted with the Bid. Failure to submit the certificate may result in rejection of the Bid. Prequalification is required irrespective of the contract amount. Bidder shall comply with the applicable provisions of the Fair Labor Standards Act. The Central Florida Expressway Authority, in accordance with the Provisions of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000e et seq., the Florida Civil Rights Act of 1992, as amended, 760.10 et seq., Fla.
