Contractor shall furnish all labor, materials, equipment, supervision and other services to perform the work described in the Drawings and Specifications attached as Exhibit A, and any requirements set forth in any other Contract Documents enumerated in Article XIX (herein after the "Work"). Contractor acknowledges and agrees that Contractor shall not utilize the specific designations, headings or other arrangements of information in the Specifications or on the Drawings as a basis for refusing to perform a portion of the Work as defined by the totality of the terms and conditions of this Contract.Contractor shall exercise a high degree of skill, care and diligence in the performance of the Work. Contractor warrants that Contractor will (i) perform, supervise and direct the Work using the Contractor's best skill and judgment, in a good and work man like manner and in the best and most expeditious and economical manner consistent with the interests of Owner, (ii) utilize his best skill, efforts and judgment in furthering the interests of Owner, (iii) perform the Work in strict compliance with applicable laws such that the Work, no later than the date for Final Completion will comply with all applicable laws, and (iv) furnish efficient business administration and supervision strictly in compliance with the Contract Documents. Contractor agrees to employ only orderly, competent and skillful people to do the Work and agrees that whenever Owner shall inform Contractor in writing that any person(s) or subcontractors on the Work are, in Owner's opinion, incompetent, unfaithful or disorderly, such person(s) shall be discharged from the Work and shall not again be employed on the Work without Owner's written consent, which consent may be withheld in Owner's discretion.
