Question Deadline 09/30/2024 Response to questions/requests for clarifications issued October, 7 2024 Anticipated Contract Start Date January 1, 2025 Contract Period: It is the intention of the University to enter into a contract for the term of five (5) years, from date of award (anticipated to be January 1, 2025). Minority Owned Sub-Contracting Goal: 15% Women Owned Sub-Contracting Goal: 15% Service-Disabled Veteran-Owned Business Contracting Goal: 6% Contract term: 5 year Location: SUNY Delhi, 454 Delhi Dr. Delhi NY 13753. Restricted Period September 23, 2024 - Award date In accordance with the requirements of New York State Finance Law Sections 139j and 139k ("Lobbying Law"), the restricted period for this procurement is now in effect. Therefore, all communications regarding this procurement must be handled through the State University of New York's designated contacts only. Should the above referenced method of adjustment become unworkable due to market conditions outside of the supplier's control such as substantial increase in Tipping or Recyclable Processing Fees, the closing of landfill sites, or restrictions placed on dumping specific type wastes, University reserves the right to negotiate an amendment to compensate the Supplier for such increases provided that the increase in costs creates at least a 25% increase in cost upon the Supplier within a one year period and that the following conditions are met SUNY Delhi has a bid opportunity for the removal and recycling of all refuse from the campus per all applicable Federal, State, County, City, Village laws and regulations per bid specifications. All bidders are to make themselves familiar with the site locations and pickup points. Bidder must be a registered waste hauler/business/license in New York State and have all the necessary permits, insurances and equipment to carry out this contract. Pursuant to State Finance Law 139-j and 139-k, this solicitation, US092923 includes and imposes certain restrictions on communications between a Governmental Entity and an Offerer/Bidder during the procurement process. An Offerer/Bidder is restricted from making contacts from the earliest notice of intent to solicit proposals through final award and approval of the Procurement Contract by SUNY Delhi and, if applicable, the Office of the State Comptroller ("restricted period") to other than designated staff unless it is a contact that is included among certain statutory exceptions set forth in State Finance Law 139-j(3)(a). N.Y. State Finance Law 139-l: Pursuant to N.Y. State Finance Law 139-l, every bid made on or after January 1, 2019 to the State of any public department or agency thereof, where competitive bidding is required by statute, rule or regulation, for work or services performed or to be performed or goods sold or to be sold, and where otherwise required by such public department or agency, shall contain a certification that the bidder has and has implemented a written policy addressing sexual harassment prevention in the workplace and provides annual sexual harassment prevention training to all of its employees. Such policy shall, at a minimum, meet the requirements of N.Y. State Labor Law 201-g.
