Such bidder's security must be in an amount not less than ten percent (10%) of the maximum amount of bid, as a guarantee that the bidder will enter into the proposed Contract, if the same is awarded to such bidder, and will provide the required performance and payment Bonds, insurance certificates and any other required documents. In the event of failure to enter into said Contract or provide the necessary documents, said security will be forfeited The successful bidder shall commence work with the issuance of the Notice to Proceed and per the project schedule referenced below. The District has established a liquidated damage rate of $1,000.00 per calendar day for each and every calendar day that the work remains fully uncompleted or unaccepted by the District. Bidders are hereby notified that pursuant to section 1770 et seq. of the Labor Code of the State of California, the Director of Industrial Relations has ascertained the general prevailing rate of per diem wages and the rates for overtime and holiday work in the locality in which the work is to be performed for each craft, classification or type of workman needed to execute the Contract which will be awarded to the successful bidder. Copies are on file with and available upon request from the District. At the request and expense of the successful bidder, securities equivalent to the amount withheld from progress payments (i.e., retention) may be deposited with the District, or with a state or Federally chartered bank as the escrow agent (the successful bidder shall bear all costs of escrow) and the District shall pay monies which would otherwise be retained to the successful bidder. The form of escrow agreement and securities eligible for investment pursuant to this option shall be governed by Public Contract Code Section 22300 and Government Code Section 16430. Within 10 days after notification of the Award of Contract, the successful bidder or bidders will be required to furnish, simultaneously with execution of the Contract, a Labor and Material Payment Bond and a Faithful Performance Bond in the form required by the District, each in an amount equal to one hundred percent (100%) of the Contract Price from an admitted surety company as defined in Code of Civil Procedure section 995.120.
