Each bid must be accompanied by a certified check, bank check or bid bond payable to the Incorporated Village of Rockville Centre in the amount of five (5%) percent of the gross amount of the bid. Award of Contract will be made to the lowest responsible bidder in accordance with applicable provisions of the law. The Village reserves the right to reject all bids or make such determination as in the best interests of the Village, as provided by law. SECTION G: PERFORMANCE BOND and LABOR MATERIAL BOND Before commencing work, the successful bidder shall provide from a recognized surety company a guarantee that if a contract is awarded to the bidder, the surety company will supply bond to the bidder. The bond shall be in force up to and including one (1) year after date of contract signing. The "BOND" shall be executed by a surety company acceptable to the Village, in an amount equal to one hundred percent (100%) of the Contract. The cost of such bond is to be borne by the bidder. SECTION H: MAINTENANCE BOND A separate maintenance bond provided by the successful bidder shall take effect upon final payment of the work by the Village and remain in effect for a period of two (2) years. The maintenance bond shall be executed by a surety company acceptable to the Village, for the guarantee period. The maintenance bond shall be in an amount equal to one hundred (100%) of the total amount of the final Contract price. SECTION I: EXECUTION OF CONTRACT Failure of the successful bidder to enter into a Contract in accordance with the proposal and/or to meet the requirements of the Village as set forth in these instructions and specifications, pursuant to such contract, within ten (10) work days after notice of the acceptance of this bid has been mailed, by Certified Mail, to the address given in the proposals, shall give the Village the right to recall and reject this bid. In the event that the successful bidder fails to enter into Contract as specified above, the Bid Bond or Bid Deposit of the bidder will be forfeited to the Village of Rockville Centre and possible exclusion from further bids for the Villag of Rockville Centre. SECTION J: INSURANCE The independent contractor shall maintain at a minimum the following insurance giving evidence of same to Inc. Village of Rockville Centre on the form of Certificates of Insurance, copies of the General Liability Declaration Page and copy of the Additional Insured Endorsement, providing 30 days notice of cancellation, non-renewal or material change. New York State licensed carrier is preferred; any non-licensed carriers will be accepted at the Municipalities discretion. The insurance carrier must have an A.M. Best Rating of at least A- IX. All subcontractors must adhere to the same insurance requirements.
