Contractor, for and in consideration of the payment to be made to Contractor as hereinafter provided, shall furnish all plant, labor, technical and professional services, supervision, materials and equipment, other than such materials and equipment as may be specified to be furnished by MTS, and perform all operations necessary to complete the Work in strict conformance with the Contract Documents (defined below) for the following public work of improvement: ADA BUS STOP UPGRADES Contractor is an independent contractor and not an agent of MTS. The Contractor and its surety shall be liable to MTS for any damages arising as a result of the Contractor's failure to comply with this obligation. MTS Issues Response to Written Questions/Clarifications and/or RFAs Deadline: October 7, 2024. Bids shall be firm for one hundred and twenty (120) days from and after the stated closing time. Time is of the essence in the performance of the Work. The Work shall be commenced by the date stated in MTS's Notice to Proceed. The Contractor shall complete all Work required by the Contract Documents within 182 calendar days from the commencement date stated in the Notice to Proceed. By its signature hereunder, Contractor agrees the Contract Time is adequate and reasonable to complete the Work. Contractor will pay MTS the sum of $1,280 for each and every calendar day of delay beyond the time prescribed in the Contract Documents for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. Each Bid must be accompanied by cash, a certified or cashier's check, or a Bid Bond in favor of MTS in an amount not less than ten percent (10%) of the Total Bid Price. The successful Bidder will be required to furnish MTS with Payment and Performance Bonds equal to 100% of the Contract Price. Bonds shall be on the forms included in the Contract Documents.
