bid packages associated with: Fort Wayne Community Schools Renovation of Miami Middle School Rebid of Bid Package 4-1 Masonry Each bid proposal shall include all labor, material and services necessary to complete the projects in strict accordance with the drawings and specifications as prepared and on file in the office of: Moake Park Group, Inc. 7223 Engle Road Suite 200 Fort Wayne, IN 46804 Bids will be opened and read aloud immediately after the submission of proposals in the Facilities Training Room of Fort Wayne Community Schools, located at 1519 Catalpa Street, Fort Wayne, Indiana. Bids received after that time or in another location shall be returned to the bidder unopened. Bids for each bid package shall be received from a single prime contractor. Each bid shall be accompanied by a certified check, a cashier s check or a bid bond executed by a surety company which is authorized to do business in the State of Indiana, made payable to the CME Corporation and in an amount equal to five percent (5%) of the bid. I n the event a bidder withdraws its bid or fails to execute a satisfactory contract within ten (10) days after the contract is awarded to such bidder by CME Corporation , CME Corporation may declare the certified check, cashier s check or bid bond forfeited to CME Corporation , as liquidated damages. A bid may not be modified, withdrawn or cancelled by the bidder for sixty (60) days following the time and date designated for the receipt of bids without the consent of CME Corporation and the Owner . CME Corporation and the Owner reserves the right to reject any and all bids or waive any or all informalities, irregularities and/or inconsistencies in, or with respect to, any or all bids. Fort Wayne Community Schools reserves the right to assign all or any portion of any bid and/or contract to any non-profit building corporation controlled by Fort Wayne Community Schools without the consent of any other party, and any employee of Fort Wayne Community Schools may be designated by Fort Wayne Community Schools and/or any such non-profit building corporation to serve as the authorized agent or representative of such non-profit building corporation with respect to any such bid or contract. All contracts awarded in connection with these projects and all obligations of payment by Fort Wayne Community Schools or any non-profit building corporation controlled by Fort Wayne Community Schools shall be conditioned upon and subject to obtaining financing or other funds sufficient to pay all of the amounts set forth in such contract. All awarded contracts will be subject to termination, without penalty or liability, at the option of Fort Wayne Community Schools or any such non-profit building corporation at any time after execution of such contract in the event Fort Wayne Community Schools determines that funds will not be sufficient to pay all of the amounts set forth in such contract. Performance and Labor and Material Payment Bonds in an amount equal to one hundred percent (100%) of the contract amount shall be required to be provided by the successful bidder to CME Corporation and the Owner no later than ten (10) days after the execution of such contract. Such bonds shall remain in full force and effect for a period of twelve (12) months after the date of Substantial Completion.
