New building addition to the east of the existing Moody County Boys & Girls Club facility, generally consisting of daycare facility. The low responsive bidder will be required to certify the following: This agreement is for services related to a project that is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act ("IUA"), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget's Memorandum 22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18, 2022. Davis-Bacon and related acts provisions apply to this project. All provisions relative to those acts must be met. Davis Bacon wage rates must be used. All contractors must be registered in SAM (System for Award Management). It is the Bidder's responsibility to ensure any subcontractors are not on the debarred contractors list. Bidders must comply with the requirements of Public Law 115-232, Section 889, Prohibition of Certain Telecommunications and Video Surveillance Services or Equipment. Payment for all work shall be in cash based on monthly payment applications to the Owner. The Architect shall act on behalf of the Owner for certification of all payment applications pursuant to the General Conditions to the Agreement for Construction. Bids may not be withdrawn after the time fixed for opening them. The Owner reserves the right to reject any and all bids, and to waive any irregularities therein. Upon request, in accordance with South Dakota Codified Law 5-18B-1, one copy of electronic or paper Plans and Specifications shall be furnished, without charge, to each Prime Contractor resident in South Dakota who intends, in good faith, to submit a bid to the Boys & Girls Club of the Northern Plains, Inc. Additionally, if a paper copy is provided under the conditions of SDCL 5-188-1, in consideration of the documents being provided at no charge, unsuccessful bidders agree to return the documents to the office of Architect, at the address listed above, within thirty (30) days after the bid opening.
