A Bid bond shall accompany each Bid in an amount not less than five percent (5%) of the Bid amount and shall be valid for a period not less than one hundred twenty (120) days. If a Bid bond is used, the Bidder shall complete and submit the Bid bond form provided in this solicitation. After the County and the successful Bidder have executed a written Contract and the successful Bidder has recorded an acceptable performance and payment bonds or if one hundred twenty (120) days have passed after the date of the formal opening of the Bids and no Contract has been awarded, the Bid security of any Bidder will be returned upon written demand. The County Performance and Payment Bond form shall be used. No other forms will be accepted without prior approval from the County.
