Contingency Repair of Guardrail, Attenuators, and Fence Reservation of Rights: The Commission reserves the right to: reject any and all Bids; to seek other Bids; and to waive minor technicalities or minor irregularities noted in a Bid submitted when in the best interest of the Commission. Under no circumstances will the Commission be responsible for any costs incurred by any Bidder submitting a Bid in response to this Invitation. Withdrawal of Bids: A Bidder may withdraw its Bid, provided the written request to withdraw is in the hands of the Procurement Manager by the time set for the Opening of Bids. When such Bid is reached, it will be returned to the Bidder unopened. No Bid may be withdrawn after it has been opened, except under such circumstances and upon such terms and conditions as the Commission may require. If Specified in the Notice to Bidders, No Bid Will Be Considered Unless Accompanied by a Bid Guaranty in the Proper Amount. The Bid Guaranty May Be in the Form of a Combined Bid Guaranty/performance Bond or Certified Check, Cashier's Check or Letter of Credit and Shall Be in the Amount Called for in the Notice To Bidders. Bid Validity: Bids are valid for sixty (60) calendar days after Bid Opening during which time the Commission shall either award or reject Bids. If no action is taken during the sixty (60) calendar day period, the Bids shall become invalid. Questions and Inquiries Concerning Bid or Contract: If a Bidder has a question or inquiry concerning the Bidding Documents or concerning any technical requirements relating to the equipment or services to be furnished, inquiry should be made to (purchasing@ohioturnpike.org). Performance Bond: If the notice to Bidders required the submission of the Bid Guaranty/Performance Bond, but the Performance Bond was not submitted as a Combination Bid Guaranty/Performance Bond with the Selected Bidder's Bid, the Commission will send the Performance Bond Form to the Selected Bidder. The Selected Bidder must execute the Performance Bond with its surety and return the signed instrument to the Commission within ten (10) days. Thereafter, the Commission will issue the Purchase Order to the Selected Bidder. The bond shall be maintained by the Contractor until completion of the Contract. In the event of insolvency of the surety, the Contractor will forthwith obtain a bond with other surety satisfactory to the Commission. The Selected Bidder's failure to furnish a Performance Bond within the time specified, shall be just cause for the revision of the selection and the forfeiture of the Bid Guaranty to the Commission, not as a penalty but as liquidated damages, and an award may then be made to the lowest responsive and responsible among the remaining Bidders, or the Bids rejected and the Invitation re-advertised as the Commission may decide in its sole discretion.
