Bids shall be clearly marked "Bid for the Polk County - Safe Routes to School Grant Project" showing the date and time of the public Bid Closing, as well as the Bidders name, and shall be delivered to the location specified above, by or before the above Bid Closing time. By no later than 4:00 p.m. local time on January 17, 2024 each Bidder shall deliver to Todd Whitaker, Public Works Director at the same address as the Bids were delivered to, the "First Tier subcontractor Disclosure Form" contained in the Bid Booklet. This form shall be submitted regardless of the Bid total. Bidders who fail to submit the required disclosure form will be considered non-responsive, and their Bid will not be considered for Award. The disclosure form shall be submitted in a separate sealed envelope clearly marked "Disclosure Form for the Polk County - Safe Routes to School Grant Project" showing the date and time of the disclosure submittal deadline, as well as the Bidders name, and shall be delivered to the location specified above, by or before the disclosure submittal deadline. The Work for Schedule A includes, but is not limited to, approximately 581 ton of Asphalt Concrete Pavement, 1,721 linear feet of Concrete Curbs, Curb and Gutter, 1,528 sq. yd. Subgrade Geotextile and 15,361 linear feet of Longitudinal Pavement Markings - Durable. The Work for Schedule B includes, but is not limited to, approximately 125 ton of Asphalt Concrete Pavement, 274 linear feet of Concrete Curbs, Curb and Gutter, 372 sq. yd. of Subgrade Geotextile and 350 linear feet of Longitudinal Pavement Markings - Durable. It is expected that the successful Bidder shall meet the highest applicable industry standards in providing this scope of work. Plans and specifications may be examined at: 1. Polk County Public Works, 820 SW Ash Street, Dallas, OR 97338 2. Daily Journal of Commerce Plan Center (Portland), 2840 NW 35th Avenue, Portland, OR 97210 Prequalification with the State of Oregon is not required to submit a Bid for this Work. Bids received from Bidders who do not appear to be registered on the "Plan Holders" list will not be considered. All Bids shall be accompanied by a Bid Bond equal to ten percent (10%) of the total Bid, to be forfeited to the Owner in the event of failure of the Bidder to execute the Contract. A one hundred percent (100%) Performance and Payment Bond will be required to guarantee the faithful performance of the Contract. It is required that the surety issuing such bonds be duly authorized and licensed to transact surety business in the state of Oregon. The Owner reserves the right to postpone the Award for up to 30 days, to delete certain items from the Bid Section, and to award the Contract to the lowest responsible Bidder. The Owner also reserves the right to reject any Bid not in compliance with all public contracting procedures and requirements or for good cause upon finding by the Owner that it is the public interest to do so. All schedules and all bid alternates are to be bid. No alternate or partial Bids are allowed, except as provided for by the schedule of prices or by written Addenda from the Engineer. 2. Basis of Award: After the Bids have been opened and a determination is made that a Contract is to be awarded, the Contract will be awarded to the lowest responsible Bidder for the sum of Schedule A and Schedule B combined. 3. Rejection of Bid: The County may reject a Bid if it finds: a. The Bidder has notsubstantially complied with all prescribed bidding procedures and requirements; b. If it is in the public interest to reject some or all of the Bids; c. The Bidder has not met the standards of responsibility, considering whether the Bidder has: i. Available the appropriate financial, material, equipment, facility and personnel resources and expertise, necessary to indicate the capability of the Bidder to meet all contractual responsibilities; ii. Current, necessary licenses; iii. Liability and other insurance in amounts necessary to meet Bid requirements; iv. Workers compensation coverage pursuant to ORS 656.407 or 656.128; v. Made the first-tier subcontractor disclosure required by ORS 279C.370; vi. A satisfactory record of performance; vii. A satisfactory record of integrity; viii. Qualified legally to contract with the County; ix. Supplied all necessary information in connection with the inquiry concerning responsibility. If a Bidder fails to promptly supply information requested by the County concerning responsibility,the County shall base the determination of responsibility upon available information, or may find the Bidder not to be responsible; and x. Not be debarred by the County under ORS 279B.130.
