The California Department of Forestry and Fire Protection (CAL FIRE) is in need of Snow Removal services for Amador El Dorado Tahoe Unit (AEU) located at 1520 Sawmill Road, South Lake Tahoe, CA 96150. Contractor shall provide all materials, labor, equipment, tools, permits, taxes, transportation, and fees to snow removal services. In the opinion of California Department of Forestry and Fire Protection (CAL FIRE), this IFB is complete and without need of explanation. It is the responsibility of the Bidder to access the electronic bidding system for any changes or addenda that may be posted. Contractor agrees to provide to the California Department of Forestry and Fire Protection (CAL FIRE) Amador El Dorado Tahoe Unit (AEU) Snow Removal, as described herein: Contractor shall provide all materials, labor, equipment, tools, permits, taxes, transportation, and fees for Snow Removal services. The Agreement may be amended to increase services at the rate(s) specified in Attachment 1, Rate Sheet. Subcontracting is permitted under this Agreement if subcontractors are included on the Bidder Declaration (GSPD05-105), Attachment 2. The services shall be performed at 1520 Sawmill Road, South Lake Tahoe, CA 96150. Any reference to CAL FIRE Project Representative shall also include their designee. This Agreement will commence on January 02, 2024 (estimated), or upon approval by CAL FIRE, whichever is later, and no work shall begin before that time. This Agreement is of no effect unless approved by CAL FIRE. Contractor shall not receive payment for work performed prior to approval of the Agreement and before receipt of notice to proceed by CAL FIRE Project Representative. This Agreement shall expire on January 01, 2027 (estimated). The services shall be provided, Sunday through Saturday, 3:00 a.m. to 5:00 p.m. The parties may amend this Agreement as permitted by law. The awarding agency reserves the right to reject all bids. The agency is not required to award an agreement. Service shall not begin prior to the express date set by the CAL FIRE Project Representative and the Contractor, after all approvals have been obtained, and the Agreement is fully executed. Should the Contractor fail to commence work at the agreed upon time, the CAL FIRE Project Representative, upon five (5) days written notice to the Contractor, reserves the right to terminate the Agreement. In addition, the Contractor shall be liable to CAL FIRE for the difference between Contractor's bid price and the actual cost of performing work by the second lowest bidder or by another Contractor. Right to Terminate A. Termination for Cause The agreement can be immediately terminated for cause. (Refer to GTC, Exhibit C, Item 7. Termination for Cause) B. Termination without Cause The State reserves the right to terminate this agreement subject to 30 days written notice to the Contractor. Contractor may submit a written request to terminate this agreement only if the State should substantially fail to perform its responsibilities as provided herein.
