Bidding for the above described work must be submitted on forms which are included in the bidding packet. All forms must be returned with bid. All bids must be accompanied by a Bid Guaranty in the form of (1) a Certified Check, or Revocable Letter of Credit, pursuant to Chapter 1305, ORC, in an amount not less than ten percent (10o/o) of the total amount of the base bid plus all alternates; or (2) a Bid Bond, drawn upon an acceptable surety Company, for the full amount of the bid plus all alternates, (100%) of the bid, both forms of guaranty as provided in Chapter 153 of the Ohio Revised Code. The Bid Guaranty shall be made unconditionally payable to the Board of Commissioners of the County of Jefferson, State of Ohio. All Bid Guarantees shall be conditioned that if the bid is accepted within sixty (60) days of the bid opening, a proper contract shall be executed, and that upon failure or refusal to enter into said contract within ten (10) days after receipt of notification of award, the bidder and the surety on any bond shall be liable to the Board of Commissioners of the County of Jefferson, State of Ohio, in an amount not to exceed ten per cent (10%) of the bid. The successful bidder upon receipt of the Notice of Acceptance of the bid, must furnish a Performance Bond in the amount of one hundred per cent (100%) of the Agreement amount to the Board of County Commissioners of the County of Jefferson, State of Ohio, said Bond to be made unconditionally payable to the Board of County Commissioners, County of Jefferson, State of Ohio. Upon rejection of any bid, the Bid Guaranty shall forthwith be returned to the unsuccessful bidder upon the proper execution and securing of the Contract. All bidders shall note the Prevailing Wage Rates, published by the Ohio Department of Development, 0ffice of Housing and Community Partnerships, are to be fully complied with throughout this project. All bidders shall pay particular attention to the rules and regulations of the EQUAL OPPORTUNITY POLICY, and to the AFFIRMATIVE ACTION PLAN, throughout the term of the project. The NON-COLLUSION AFFIDAVIT OF PRIME BIDDERS must be completed and submitted with all bids. Pursuant to Ohio Revise Code Section 9.24, it is now mandatory that prior to awarding of contracts, goods, services or construction for Jefferson County, a search must be made on the FINDING FOR RECOVERY DATABASE of the Auditor of the State of Ohio to determine if a prospective successful bidder has a finding against it for non-payment of an obligation to the State or political subdivision thereof. No bidder may withdraw his/her bid during a period of sixty (60) days after the date of the bid opening. All bids must be identified by marking the envelope VILLAGE OF DILLONVALE 5TH STREET STORM SEWER REPLACEMENT. If in the opinion of the Board of Commissioners of the County of Jefferson, State of Ohio, the acceptance of the lowest bid is not in the best interest of all concerned, the Board of County Commissioners of the County of Jefferson, State of Ohio, may accept another bid so opened. The Board of Commissioners of the County of Jefferson, State of Ohio, reserves the right to accept or reject any and all proposals and to waive all informalities. The Board of Commissioners of the County of Jefferson, State of Ohio, may reject any or all of the bids on any basis and without disclosure of a reason. The failure to make such a disclosure shall not result in accrual of any right claim, or cause of action by any unsuccessful bidder against the County of Jefferson. Special attention should be given to the Bid Bond Requirements as stated above.
