This is a public notice of Park City Municipal Corporation's intent to waive a competitive procurement process. Rule 5-3 of the Park City Municipal Corporation (PCMC) Procurement Rules provides that the competitive procurement requirements for certain procurements may be waived under certain circumstances and when there is reasonable justification for such a waiver. The Procurement Official has determined that a waiver is appropriate based on the information below. Waiver Justification: Awarding the contract through the Standard Procurement Process is impractical and not in the best interest of PCMC because procurement of the services is an upgrade of the existing equipment, and it is unlikely to produce competition because of the complexity of the existing system. The scope and complexity of services that PCMC is seeking to contract for makes it unlikely that the Standard Procurement Process would result in competition and would instead only increase the cost and time for PCMC to acquire the services. The Service Provider is the original company the City hired to install the projection and audiovisual system and has specific knowledge of how the system is built and utilized. The equipment has been failing since 2020. The equipment upgrades and replacement are long overdue and needed for the Park City Library to function as a public facility, including use by the community and several City tenants. This equipment will provide a much more accessible way for the community to use the Jim Santy Auditorium and for the library staff to facilitate rentals. Park City Film and Sundance Institute are not interested in another vendor and the parties' respective equipment responsibilities are outlined in a Three-Party Agreement. The Service Provider understands how to communicate with PCMC, the Film Series, and the Sundance Institute and will upgrade the projection and audio-visual equipment efficiently and effectively If any party has comments regarding the City's intended procurement by waiver of the competitive solicitation process, please email Jenny Diersen at jenny.diersen@parkcity.org within seven days of this notice.
