Deadline for Questions. For comments that affect bid items and/or quantities: Noon Tuesday prior to bid opening. For questions and comments requiring clarification only: Noon Wednesday prior to bid opening. The work order on these projects shall be issued 30 (thirty) calendar day Completion Date. The work on these projects shall be completed within 100 (one hundred) total for all 4 projects working days from the date of beginning work for all projects and in accordance with the plans and Standard Specifications. Working days will be charged as provided for in the Standard Specifications, once the work order is issued. The non-availability of material shall not prevent working days from being assessed. Contractor and City shall agree on project schedule. Contractor shall not deviate from the agreed upon schedule without prior written approval from the City. Any unauthorized deviation by Contractor shall result in written Performance Failure. Depending on nature of schedule delay, the City may also levy liquidated damages On State/Federal-aid contracts, Contractor is required to pay Davis-Bacon wages and meet the requirements of the Davis-Bacon Wage Act for the entire project, including non-participating work. Compliance with the Davis-Bacon Act (40 U.S.C. 276a to a-7) as supplemented by Department of Labor regulations (29 CFR Part 5) (Construction contracts in excess of $2,000 awarded by grantees and sub grantees). On State/Federal-Aid contracts, Contractors and Subcontractors must have an EEO policy on file with the Office of Civil Rights Compliance. Each contractor and subcontractor is responsible for submitting their company's EEO policy on their company letterhead, a letter of appointment of the company's EEO officer, and the DOT 1049 CFR Form. If a contractor has 50 or more employees, an Affirmative Action Plan is also required. The City reserves the right to refuse to award the project to a prospective bidder if the bidder is in default for any of the following reasons: a. Failure to comply with any prequalification regulations of the City, if such regulations are cited, or otherwise included, in the proposal as a requirement for bidding. b. Failure to pay, or satisfactorily settle, all bills due for labor and materials on former contracts in force with the City at the time the City issues the proposal to a prospective bidder. c. Documented record of Contractor default under previous contracts with the City. d. Documented record of unsatisfactory work on previous contracts with the City 23-06-E530
