Sidewalk Safety Program This contract shall be used only to request for the Repair of Sidewalks, Driveways, Curbs, Hillside Stairways and Pavers Inside the Corporate Limits of the City of Cincinnati, or Outside the City but Within the Service Limits of City Departments This contract shall not be used to request work to be performed on office buildings or any other structure intended for administrative purposes. MBE 5% / WBE 5% A Bid Bond, deposit of cash or Certified Check, Bank Cashier s or Bank Official s Check drawn on a solvent bank payable to the Treasurer of the City of Cincinnati, in the amount of not less than ten percent (10%) of the total amount of the bid must accompany each bid as a guarantee that if the bid is accepted a contract will be entered into. The contractor will be required to provide performance surety in the amount of $3,848,684.00. The bond surety amount shall be the maximum compensation allowable under this contract. The contract shall automatically terminate upon reaching the bond threshold unless the City and Contractor have mutually agreed, via the issuance by the City Purchasing Agent of an authorized Change Order and a bond rider, to increase the performance bond amount. The City may terminate this contract at any time for any reason upon thirty (30) days written notice to Contractor. If, through any cause, the contractor shall fail to fulfill in a timely and proper manner the Contractor's obligations under this contract or if the Contractor violates any of the terms and conditions, covenants or agreements of the Contract, if no attempt is made to cure the failure within a period of ten (10) days or a longer period specified in writing, the City of Cincinnati shall have the right to terminate this Contract by giving written notice to the Contractor specifying the effective date of the termination, at least five (5) days before such effective date. Notwithstanding the above, the Contractor shall not be relieved of liability to the City of Cincinnati for damages sustained by the City of Cincinnati by virtue of any breach of this Contract by the Contractor, and the City of Cincinnati may withhold any payments to the Contractor for the purpose of set-off until such time as the exact amount of damages due the City of Cincinnati from the Contractor is determined. Exceptions may be made with respect to defaults of subcontractors. The contractor will be required to provide performance surety in the amount of $3,848,684.00.
