The City of East Palo Alto reserves the right to reject all proposals, or include or exclude any part of the submittals in the final agreement with the selected consultant. The City reserves the right to accept or reject any and all proposals. The City also reserves the right to waive any informality or irregularity in any proposal or in the bidding as deemed to be in its best interest. All design work must be substantially completed within one hundred (100) calendar days after the Date of Commencement established in the City's initial Notice to Proceed. Final Completion shall be within 30 days of Substantial Completion. The project schematic design will be presented at one or two City Council meetings as it may be necessary, for review and approval. The DF that is awarded a contract for this Project shall procure and maintain for the duration of this contract insurance, and meet other requirements, consistent with and included in the City's standard contract, here included as Attachment 2. The City will issue a written decision (resolution) supporting its Award of the Design Agreement for the East Palo Alto Tenant Improvements Project to the successful proposer, stating the basis of the Award. The identity of the successful proposer will be publicly announced in a staff report. The resulting Design Agreement will include a complete Scope of Services for all elements of the design process necessary for the Project. The City will review DF's management of design and construction documents of the Project to ensure compliance with the contract documents. The method of Contractor Selection has not been Determined at this time.
