Repair of tanks and replacement of equipment for the existing primary clarifiers. The Work to be done under this contract consists of all labor, equipment and materials to remove the existing sludge collection units, weirs, valves, and gates, repair the tank concrete and any associated structural modifications, coat the tank, and install new sludge collection units, weirs, valve, and gates, in the primary clarifier tanks as shown on the Drawings and described in the Specifications. Question Deadline: 10/31/2023 at 4:00 PM ET Questions regarding this project must be submitted online via electronically. All questions about the meaning or intent of the Bidding Documents are to be directed to Engineer by clicking on the Questions tab within electronically. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. A Bid must be accompanied by Bid security made payable to Owner in an amount of ten percent (10%) of Bidder's maximum Bid price and in the form of a certified check, bank money order or a Bid Bond (on the form in Project Manual or equivalent) issued by a surety meeting the requirements of Paragraphs 5.01 and 5.02 of the General Conditions. Contract Documents, the Performance Bond and Payment Bond in the forms included in the Contract Documents or equivalent each in an amount of 100% of the contract amount, in favor of Owner, as required for the faithful performance and proper fulfillment. Article 5 of the General Conditions, as may be modified by the Supplementary Conditions, sets forth Owner's requirements as to performance and payment bonds and insurance. When the Successful Bidder delivers the executed Agreement to Owner, it must be accompanied by such Bonds and required insurance certificate(s). Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty), Contractor shall pay Owner $1,000.00 for each day that expires after the time specified in Paragraph 4.02 for Substantial Completion until the Work is substantially complete. After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Time or any proper extension thereof granted by Owner, Contractor shall pay Owner $1,000.00 for each day that expires after the time specified in Paragraph 4.02 for completion and readiness for final payment until the Work is completed and ready for final payment. All bonds and insurance required by the Contract Documents to be purchased and maintained by Owner or Contractor shall be obtained from surety or insurance companies that are duly licensed or authorized in the jurisdiction in which the Project is located to issue bonds or insurance policies for the limits and coverages so required. Such surety and insurance companies shall also meet such additional requirements and qualifications as may be provided in the Supplementary Conditions. This project is subject to applicable provisions of Act 422, Pennsylvania Prevailing Wage Act as amended and the prevailing minimum wage rates issued by the Pennsylvania Department of Labor and Industry, and weekly certified payrolls will be required attesting to this. Owner reserves the right to reject any and all bids for any cause whatsoever, to eliminate any item or items from the contract, and to wave any informality in the bids.
