Bids received more than ninety six (96) hours, excluding Saturdays, Sundays and holidays, before the time set for opening of bids, as well received after the time set for opening of bids, will not be considered and will be returned unopened. Within sixty (60) days from the bid opening date, the successful bidder shall execute a written contract embodying all provisions of the bidding documents. Description of Work: Rehabilitation of streets including cold milling, asphalt resurfacing, and other work as shown on the plans. Deposits will be returned to the unsuccessful bidders. Deposits will be returned to successful bidder upon execution of contract documents. Bids shall also be made in accordance with the prevailing hourly rate of wages for this locality and project as determined by the Commission of Labor and filed with the Secretary of State, a copy of which is on file with the City Clerk, in accordance with the provisions of 40 O.S. 1971, 196.1-196.12, which prevailing hourly rate of wages is made a part of this notice by reference as though fully set forth herein. The City Council of the City of Lawton reserves the right to reject any or all bids. The Owner may make such investigations as he deems necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out contract requirements and complete the work contemplated therein. Conditional bids will not be accepted. A. A good and sufficient Performance Bond in an amount equal to one hundred percent (100%) of the approximate total amount of the Contract, guaranteeing the full and faithful execution of the work and performance of the Contract and for the protection of the City and all property owners interested against any improper execution of the work or the use of inferior materials. B. A good and sufficient Statutory Bond in an amount equal to one hundred percent (100%) of the approximate total amount of the Contract, guaranteeing payment for all labor, materials, and equipment used in the construction of the project. C. A good and sufficient Maintenance Bond in an amount equal to one hundred percent (100%) of the total amount of the Contract, guaranteeing the maintenance in good condition of such project for a period of two (2) years from and after the time of its completion and acceptance by the City. The Contractor hereby agrees to commence work under this Contract on a date to be specified in a written "Work Order" of the CITY and to fully complete the project within Sixty (60) consecutive calendar days. The Contractor further agrees to pay as liquidated damages, the sum of Two Thousand Dollars and 00/100 ($2000.00) for each consecutive calendar day thereafter as provided in Paragraph 18 of the General Conditions section of the Contact Documents and Technical Specifications.
