The Company shall provide all necessary labor, materials, supervision, administration, and insurance on all services required by the Contract Documents and perform, on behalf of the City, all necessary services for the efficient and economical operation and management of the City of Sharonville Aquatic Center and concessions. Performance under this proposal shall commence on January 1, 2024, and shall terminate on December 31, 2026, unless otherwise agreed to by both parties. In addition, the contract may be continued for up to two additional one-year contract periods at a rate agreed upon by both parties. As damages may be difficult to determine, in the event that the Company breaches this contract the amount of five hundred dollars ($500) shall be assessed against operation as liquidated damages and not as a penalty, for each day that the pool is not available for use by the City or persons permitted by the City to use pool or each day that the Company is in breach or default of this agreement. Commercial General Liability Insurance. Commercial General Liability Insurance on an "occurrence" basis, including product-completed operations, with limits no less than $2,000,000 per occurrence for bodily injury, property damage, personal & advertising injury. This RFP is a request to receive offers and contains instructions for proposal submission eligibility. The City of Sharonville reserves the right to accept or reject any or all proposals.
