The City of Brownsville Engineering and Public Works Department herein after referred to as EPW has an invitation for bids for Stagecoach Trail Paving and Drainage Improvements. Question Deadline 10/25/2023 at 3:00 PM CT. Termination by the City The City of Brownsville reserves the right of unilateral termination of the contract by providing a thirty (30) day written notice of such intent. Forms Attached you will find a Disclosure of Interests Form, Litigation Disclosure Form, and a Statement of Non-Collusion. Fill in the forms and return with your bid. Certification Forms Compliance with requirements for the participation of DBE's/ Debarment, Suspension, and other ineligibility and voluntary exclusion lower tier covered transactions/ Certification regarding restrictions on lobbying. The City of Brownsville reserves the right to review, accept or reject any or all proposals received through this process. Information contained within the original proposal should be the complete offering to the City. In fairness to all proposers, no late additions or verbal additions to the original proposal will be accepted after the submission deadline. If additional information is needed from proposers, the City will initiate that request. If interviews or conferences are necessary, the City will make those arrangements as necessary. The City of Brownsville also reserves the right and option to wave any and all informalities if in its best interest. All requests for clarifications must be received in writing, no later than October 25, 2023 at 3:00 P.M. CT, by the City of Brownsville, at City of Brownsville Any questions regarding this IFB will be handled as promptly and as directly as possible. If a question requires only clarification of instructions or specifications, it will be handled verbally. If any question results in a change or addition to the IFB, the changes or additions will be forwarded to all registered firms as quickly as possible by addendum. A certified or cashier's Check or an original Bid Bond Proposal Guaranty issued by a corporate surety company licensed to do business in the State of Texas and payable to the order of the City of Brownsville, Texas, in an amount not less than five percent (5%) of the greatest total amount of the Bid Proposal, must accompany each Bid as a guarantee that if awarded the Contract, the successful Bidder will promptly enter into a Contract and execute payment and performance bonds as outlined in the specification and Contract Documents. We require 1 year warranty bond, bid bond. A Payment & Performance Bond (Only applies to Construction/Construction Rehabilitation), in an amount of not less than one hundred percent (100%) of the Contract Price, conditioned upon the faithful performance of the Contract; a Payment Bond, as required by Chapter 2253 of the Texas Government Code, guaranteeing the payment of all persons supplying labor and furnishing materials; and an Extended Warranty Bond, either by separate instrument or incorporated in the foregoing bonds, will be required. Payment and performance bonds provided to the City of Brownsville for these purposes are required to conform with Article 7.19-1 of the Texas Insurance Code. LIQUIDATED DAMAGES The undersigned BIDDER further agrees to complete the project and achieve substantial completion/Delivery within 425 Consecutive Working Days submittal from the date of Commencement/shipment, unless such time is extended by the City of Brownsville and that One Thousand Dollars ($1,000.00) per each consecutive calendar day will be the measure of liquidated damages assessed the undersigned for each calendar day in excess required to complete work and/or delivery under the contract for each portion of the project. BID AWARD Bid award will be made on ALL on nothing basis. BID PRICING The bid prices quoted on this form are firm bid prices, which are good for Ninety (90) calendar days following the acknowledgement of bids and are not subject to price adjustments. I have attached and initialed a copy of the City's specifications for the item(s) on this form to clarify my understanding as to what features shall be required in the goods and/or services. The contractor shall, at no expense to the City, instruct their insurance agent or carrier to furnish a certificate of insurance attesting to the issuance of policies affording coverage as required and listed in this section. Certificates required by this contract shall be submitted prior to award of the contract and should be forwarded.
