The Contractor has agreed and by these presents does agree, with the City, for the consideration mentioned in the Proposal and herein contained or hereto annexed, to furnish at their own proper cost and expenses, all the necessary materials and labor every description and to carry out and complete in a workmanlike manner, ready for continuous operation, the improvement known as: "Pickleball Courts - Lefferson Park" and in accordance with the Specifications for this contract hereinafter set forth or hereto attached, subject to such change as may be made from time to time by the City Manager. Bidders must comply with the State Prevailing Wage Rates of Public Improvements in Butler County and the City of Middletown, Ohio as determined by the Ohio Auditor of State Division of Industrial Compliance and Labor. A certified check on a solvent bank, drawn and made payable to the Treasurer of the City of Middletown, Ohio, or a bid bond by a surety company licensed to do business in Ohio, in a sum not less than ten percent (10%) of the total amount of the bid, as surety for the execution of the contract shall accompany each proposal. The checks of all bidders will be returned upon execution and securing of the contract. The successful bidder will be required to execute the contract and to provide a 100% performance bond within ten (10) days after the award of the contract. In case the bidder neglects to execute the contract, the check accompanying the proposal shall be forfeited to the City of Middletown, not as penalty, but as liquidated damages. The right to reject any and all proposals is reserved by the City of Middletown. Informalities may be waived at the option of the City Council
