Bids must be made on the standard proposal form in a manner designated therein and required by the specifications. They shall be enclosed in an opaque sealed envelope addressed to the Mayor and Committee of the Township of Neptune, ATTN: Municipal Clerk, bearing on the outside the name of the bidder, their address, and the name of the contract for which the bid is submitted. Bids must be accompanied by a certificate from a surety company approved by the Township stating that it will provide the specified performance and maintenance bonds in the event that the contract is awarded to the bidder. Bids should be dropped off at the Township Clerk's Office, 25 Neptune Boulevard, Neptune, New Jersey. Each bid must be accompanied by a certified check or cashier's check drawn on an incorporated bank or trust company and made payable to the Township of Neptune, or a bid bond duly executed by the bidder as principal and having as surety thereon a surety company approved by the Township of Neptune in the amount not less than ten (10) percent of the amount of the bid but in no case in excess of $20,000. Such shall be without endorsement or conditions. The checks of all bidders and bid bonds will be returned according to law and no interest shall be allowed upon any such check. In the case the contract is awarded to the bidder, they will, within ten (10) days thereafter, execute such contract and furnish satisfactory performance bond. Upon failure to do so without written approval by the Township of Neptune, they shall forfeit the deposit as a partial satisfaction of liquidated damages and the acceptance of the bid will be contingent upon fulfillment of this requirement by the bidder. Bidders are required to comply with all applicable Laws and Regulations including P.L. 1975, C.127 (Affirmative Action) P.L. 1999, C.238 (Public Works Contractor Registration) and P.L. 1963, C. 150 (Prevailing Wages). Bidders are required to comply with requirements of NJSA 10:5-31., NJAC17:27(Affirmative Action), and Americans with Disabilities Act of 1990 (42 USC 12101, et seq.). Please be advised that this project is funded by the Township of Neptune. By virtue of Executive Order #34 (1976) venders currently suspended, debarred or disqualified are excluded from participation on this project. The Contract shall be awarded, or all bids rejected, within sixty (60) days from the receipt of bids within such extensions of time as permitted by law. The Mayor and Committee reserve the right to reject any and all bids, or to waive any informality of any bid. *The list of planholders and/or interested bidders is not being tracked by the stakeholders involved with this project.
