No contractual obligations of SCJCSEC will arise from the RFP process until a formal subcontract has been executed by duly authorized representatives of SCJCSEC and the Bidder. 2 SCJCSEC reserves the right to accept or reject all submissions, to revise the AO, to request one or more new submissions or clarifications from one or more Bidders, to negotiate with one or more Bidders or to cancel the tender in part or in full when it is in the best interests of the SCJCSEC. Any request for a new submission or for clarification and/or negotiation made to the Bidder will form part of any subsequent subcontracting contract and will be incorporated therein. 3 SCICSEC reserves the right to have exclusive negotiations whose conditions could be different from those originally requested or offered. In addition, the SCJCSEC reserves the right to modify the specifications during the AO process through addendums issued without the AO being reissued. SCICSEC reserves the right, at its sole discretion, to overlook any formal defect or minor defect that the submissions received may contain. 4 Each party is fully responsible for its own costs and expenses incurred during its participation in the RFP and the contract negotiation process. SCICSEC will not assume any liability, directly or indirectly, for any costs incurred by Bidders in the preparation and submission of their bids in response to this IFP or negotiations relating to the contract. 5 The information provided by SCICSEC is accurate to the best of our knowledge. However, SCICSEC does not guarantee the accuracy or completeness of this information. 6 An offer submitted by a Bidder under this AO represents its binding offer to enter into a contract with SCICSEC under the terms of the AO. By submitting its proposal, the Bidder acknowledges that if selected as the winning Bidder, its proposal, in part or in whole, may be incorporated into subsequent contracts that may be awarded at the sole discretion of SCICSEC.
