The city serves an area of 41.6 square miles in size and serves a population of approximately 30,962. It is located off of Florida's East Coast, in the County of Volusia, just north of Cape Canaveral with easy access to both Interstate 95 and Interstate 4. The City's fiscal year begins on October 1st and ends on September 30th. This project includes the construction of an observation deck located at the Turnbull Creek Park, the physical street address to the entrance of the park is 357 Otter Boulevard, New Smyrna Beach, Florida 32168. The observation deck will be constructed adjacent to the existing City of New Smyrna Beach paved multi-use trail. The basis of design is a 12' x 40' deck with 12' x 12' covered area and ADA accessible walkway connecting to the multiuse trail. The proposed deck will overlook Turnbull Creek and be constructed in existing wetland area. The construction will require wetland mitigation, similar to the permitting associated with the multi-use trail project. The awarded Contractor shall follow the New Smyrna Beach Airport and FAA protocols due to location proximity as applies. Due to the project being in close proximity to the New Smyrna Beach Airport, the awarded Contractor will need to work in conjunction with the city, airport staff and the FAA regarding the usage of construction equipment for the duration of the project. Attachment H provided in the Attachment Section of this document is an example form and is not needed at that time of submitting a bid The city was created in 1887 by adoption of its first charter, which was replaced by the present charter through Chapter 224.08, Special Acts of Florida, 1943. The legislative branch of the city is composed of an elected five-member City Commission consisting of the mayor and four commissioners. The City Commission is governed by the City Charter and by state and local laws and regulations. The City Commission is responsible for the establishment and adoption of policy. The execution of such policy is the responsibility of the Commission-appointed City Manager. Deadline for Written Questions: October 24, 2023, 5:00pm If the contractor selects to submit a cashiers' check or cash bond it must be received by the city Liquidated Damages The bidder further agrees to pay, as liquidated damages, the sum of ONE HUNDRED FIFTY ($150.00) DOLLARS for each consecutive calendar day thereafter, until the work is completed or accepted. Said amount is agreed upon because the injury that the City of New Smyrna Beach ("Owner") may sustain by reason of breach of contract would be impossible to ascertain or estimate; such sum is agreed upon as liquidated damages and is intended as compensation for the injury suffered by the Owner, rather than as a penalty. The bidder agrees to commence work within TEN (10) CALENDAR DAYS after the date of the Notice to Proceed letter and shall complete the work within ONE HUNDRED FIFTY (150) DAYS thereafter. The City understands that lead times are becoming an issue throughout the construction industry. Consideration for extensions will be made for documented delays on purchase orders and substantiated lead time provided by suppliers. Within fourteen (14) days of executing an agreement, the successful bidder shall deliver to the Owner, if required as a part of the Contract Documents identified in "General Conditions", an executed bond in the amount of One hundred (100%) percent of the accepted bid as security for faithful performance of his Contract and for payment of all persons performing labor or furnishing materials in connection therewith, prepared on the form of bond attached hereto or the Bond Company's document, and have as surety thereon such company or companies approved by the Owner and authorized to transact business in the State of Florida.
