The work includes removal of the existing emergency generators and installation of two (2) new emergency generators and switchgear, modifications to existing substations, demolition of existing underground fuel storage tank and construction of associated electrical ductbanks, and appurtenant site and electrical work at the Rockaway Valley Regional Sewerage Authority Wastewater Treatment Plant. No bid will be received unless in writing on the forms furnished, and unless accompanied by bid security in the form of a bid bond, cashier's check, or a certified check made payable to the Rockaway Valley Regional Sewerage Authority in an amount equal to 10% of the total bid, but in no case in excess of $20,000. All applicable surety bonds required in connection with the advertisement and award of the contract shall be written by a surety company authorized to do business in the State of New Jersey and listed on the current U.S. Department of the Treasury Circular 570. Successful bidder must furnish a 100 percent Performance and Payment Bond in the form required by N.J.SA. 2A:44-147. In accordance with N.J.A.C. 7:22-3.17(g) and N.J.A.C 7:22-4.17(g), all surety bonds must be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds) and must be authorized to do business in the State of New Jersey. This project is funded by the New Jersey Environmental Infrastructure Financing Programs and the successful bidder must comply with the provisions of N.J.A.C. 7:22-9 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged (SED) individuals. A goal of ten (10) percent for SED participation has been set for this project. The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. This contract will be funded with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24 the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27-1 et seq. All questions that Bidders may have regarding the Bid Documents shall be submitted in writing to the Engineer, Kleinfelder, Inc., 150 College Road West, Suite 100, Princeton, New Jersey 08540, 609-924-8821, fax 609-924-8831, by 2:00 p.m. prevailing time on October 25, 2023. Based on the questions submitted, the Rockaway Valley Regional Sewerage Authority may provide answers which may be in the form of an Addendum to the Bid Documents. Any Addendum will be issued on or before October 30, 2023. The Rockaway Valley Regional Sewerage Authority reserves the right to modify or change any of the Bid Documents by issuance of Addenda. In the event that a potential bidder obtains the Contract Documents in any manner other than as specified herein, the Rockaway Valley Regional Sewerage Authority will not have the contact information of the potential bidder for purposes of issuing bid addenda, if any. The non-receipt of any addenda (in the event that any addenda are issued) and the failure of the bidder to acknowledge the receipt of any and all addenda at the time of bid shall be considered a fatal defect in such Bidder's submission and said Bid shall be immediately rejected. Therefore, if a potential bidder obtains the Bid Documents in any manner other than as specified herein, said Bidder shall promptly provide written notice to the Rockaway Valley Regional Sewerage Authority accordingly. The Owner reserves the right to reject any or all Bids, should the Owner deem it to be in the public interest to do so, pursuant to N.J.S.A. 40A:11-13.2 and N.J.A.C. 7:22-9.10(a). The Contract Documents may be reviewed at the Rockaway Valley Regional Sewerage Authority Wastewater Treatment Plant, 99 Greenbank Road, Township of Parsippany-Troy Hills, New Jersey, between the hours of 9:00 a.m. and 4:00 p.m., during normal business days.Shipping charges are additional and variable depending upon the pick-up or delivery option selected by the purchaser. Bid documents cannot be obtained at the office of the Engineer, Kleinfelder, Inc.
