Project Description - Contract No. FM24-01-20, Force Main Rehabilitation - The Work, includes, but is not necessarily limited to: a. Installation of supplemental Force Main for Pump Station # 24, consisting of ~3,000 LF of 8" diameter C900 PVC Force Main, including crossing beneath NJ State Hwy Rt 70, and connection to existing gravity sewer manhole. b. Activation of newly connected, supplemental Force Main, demonstrated to the satisfaction of the Owner, upon successful completion of installation and testing. The sanitary sewer lines, etc are shown on the Drawings. The bidding period shall be a minimum of ten (10) days. Bid Security - In accordance with N.J.S.A. 40A:11-21, each Bid shall enclose Bid Security, as specified in the Instructions to Bidders, in the amount of ten percent (10%) of the Bidders Base Bid plus all alternates, but not in excess of $20,000. Addenda - Notice of revisions or addenda to advertisement or bid documents shall be in accordance with N.J.S.A. 40A:11-23(a) and N.J.S.A. 40A:11-23(c). Bidders are required to comply with the requirements of P.L. 1975, c. 127 (N.J.S.A. 10:5-33 et seq. and N.J.A.C. 17:27), equal employment opportunities P.L. 1977, c.33, corporate and/or partnership ownership and P.L. 2004, c. 57, business registration of public contracts and the "Public Works Contractor Registration Act" (N.J.S.A. 34:11). Labor Standards Provisions for Federal and Federally-Assisted Contracts - The "construction" work (as defined by the Secretary of Labor) shall be subject to the following labor standards provisions, to the extent applicable: a. Davis-Bacon Act (40 U.S.C. 276a--276a-7). b. Contract Work Hours and Safety Standards Act (40 U.S.C. 327-33). c. Copeland Anti-Kickback Act (18 U.S.C. 874). d. Executive Order 11256 (equal employment opportunity). and implementing rules, regulations, and relevant orders of the Secretary of Labor or EPA. This contract shall include and be subject to the "Labor Standards Provisions for Federally-Assisted Construction Contracts" (EPA Form 5720-4) in effect at the time of execution of this contract. Local Public Contract Requirements - The New Jersey Department of Labor and Industry's applicable prevailing wage rates are those wages and fringe benefits in effect on the date the contract is awarded. All pre-determined rate increases listed at the time the contract is awarded must also be paid, beginning on the dates specified. The Supplementary Conditions, Section 00800, also contain provisions concerning "Nondiscrimination Requirements." New Jersey Election Law Enforcement Commission - Bidders will be required to comply with the requirements of the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-20.4 and N.J.S.A. 19:44A-20.13 (P.L. 2005, c271, s.3). Surety Bonding - In accordance with N.J.A.C. 7:22-3.17(g) and N.J.A.C. 7:22-4.17(g), all applicable surety bonds required in connection with the advertisement and award of building contracts or subagreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. These specifications shall encourage free, open and competitive bidding, and shall adhere to aspects of specifying brand name or equivalent, etc., as per NJSA 40A:11-13(d).
